Abstract

Asas proporsionalitas merupakan sebuah asas yang menerapkan keseimbangan para pihak dalam sebuah perjanjian yang berisi hak serta kewajiban. Hubungan pekerja dan pemberi kerja yang dituangkan dalam perjanjian kerja, hendaknya memberlakukan asas proporsionalitas namun jarang direalisasikan terutama terhadap pekerja harian lepas yang dalam tulisan ini mengambil contoh perjanjian kerja Proyek Peningkatan Rel Kereta Api Serang-Merak Lintas Rangkasbitung-Merak dan juga kewajiban menerapkan jaminan hak bagi pekerja harian lepas Dengan menerapkan metode penelitian yang berbentuk empiris normatif, bertujuan agar penulisan dapat menampilkan data akurat yang bila dihubungkan dengan ilmu hukum dapat menjadikan dasar kuat berupa data dan dasar hukum yang berlaku. Asas proporsionalitas belum diterapkan seutuhnya karena hanya merujuk kepada besaran upah yang diterima namun hal lain yang merupakan hak pekerja seperti BPJS, tunjangan hari raya dan upah lembur tidak sesuai dengan aturan ketenagakerjaan yang terdapat dalam Undang-Undang 13 Tahun 2003 sebagaimana telah dirubah oleh Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja Kata Kunci : Proporsionalitas,Pemberi Kerja, Pekerja Harian Lepas. / The principle of proportionality is a principle that applies to the balance of the parties in an agreement that includes rights and obligations. The relationship between the worker and the employer as outlined in the work agreement should apply the principle of proportionality, but it is rarely realized, especially for casual workers, which in this paper takes the example of the work agreement for the Serang-Merak Railway Improvement Project Lintas Rangkasbitung-Merak and also the obligation to apply guarantees of rights for casual workers. By applying a normative empirical research method, it is intended that the writing can display accurate data which, when connected with legal science, can have a strong basis in the form of data and the basis of applicable law. The principle of proportionality has not been fully implemented because it only refers to the amount of wages received but other things which are workers' rights such as BPJS, holiday allowances and overtime pay are not in accordance with labor regulations contained in Law 13 of 2003the Labor regulations stipulated in Law 13 of 2003 as amended by Government Regulation in Lieu of Law Number 2 of 2022 concerning Cipta Kerja.
