Abstract
ABSTRAK Nama : Darman Saidi Siahaan NIM : 1902190047 Judul : TANGGUNG JAWAB OTORITAS JASA KEUANGAN DALAM KASUS GAGAL BAYAR PT. ASURANSI JIWASRAYA (PERSERO) Lahirnya Otoritas Jasa Keuangan (OJK) tidak terlepas dari kondisi negara Indonesia yang mengalami krisis moneter di tahun 1997, krisis ekonomi global di tahun 2008 serta krisis ekonomi eropa di tahun 2010, hingga melahirkan Undang-Undang 21 tahun 201 tentang Otoritas Jasa Keuangan (OJK). Pemerintah memutuskan bahwa semua kegiatan pengaturan dan pengawasan di industri perbankan dan asuransi menjadi kewenangan OJK. Tujuan utama pendirian OJK adalah, meningkatkan dan memelihara kepercayaan publik di bidang jasa keuangan. Menegakkan peraturan perundang-undangan di bidang jasa keuangan. Dengan menggunakan metode penelitian yuridis normative dengan spesifikasi penulisan deskriptif analitis mengenai aturan-aturan hukum khususnya yang terkait tentang PT.Asuransi Jiwasraya dan hubungannya dengan OJK dalam mengatur dan mengawasai seluruh kegiatan perbankan secara nasional. Dalam melakukan tugas dan fungsinya OJK diberikan kewenangan luas untuk membuat pengaturan, pengawasan, penyidikan, memungut iuran serta melakukan perlindungan konsumen. Kewenangan Otoritas Jasa Keuangan menunjukkan penguasaan penuh terhadap berjalannya management PT.Asuransi Jiwasraya sejak adanya OJK hingga terjadinya gagal bayar pada tubuh PT.Asuransi Jiwasraya. Kasus gagal bayar pada PT.Asuransi Jiwasraya belum mencerminkan amanat yang diemban Otoritas Jasa Keuangan seperti yang diaturkan oleh Undang-undang No.21 tahun 2011 tentang Otoritas Jasa Keuangan dan Undang-undang No.40 tahun 2014 tentang Perasuransian serta pedoman pedoman yang dilahirkan sendiri oleh Otoritas Jasa Keuangan. Banyaknya pedoman dalam melakukan tugas kewenangan pada OJK belum juga menghindarkan kasus kasus gagal bayar pada industri asuransi umumnya dan khususnya pada kasus gagal bayar PT.Asuransi Jiwasraya. Terjadinya kasus gagal bayar PT.Asuransi Jiwasraya adalah bagian dari gagalnya menjalankan fungsi dan tugas kewenangan Otoritas Jasa Keuangan. Munculnya kasus gagal bayar Asuransi Jiwasraya terjadi akibat tidak berjalannya dengan baik kelima aspek kewenangan OJK tersebut. Asuransi Jiwasraya does not reflect the mandate of the Financial Services Authority as regulated by Law No. 21 of 2011 concerning the Financial Services Authority and Law No. 40 of 2014 concerning Insurance and the guidelines that were created by itself.
