Abstract

Perlindungan hukum terhadap konsumen merupakan salah satu jenis perlindungan hukum. Perlindungan konsumen tidak dapat dipisahkan dari kegiatan jual beli, di Indonesia saat ini perlindungan konsumen mendapat perhatian yang cukup baik karena menyangkut aturan untuk menciptakan kesejahteraan rakyat. Dengan adanya Undang-Undang Perlindungan Hukum Konsumen beserta perangkat hukum lainya, konsumen memiliki hak dan posisi yang berimbang dan mereka pun bisa menggugat atau menuntut jika ternyata hak-haknya telah dilanggar atau dirugikan oleh pelaku usaha. Perlindungan hukum terjadi karena terdapat suatu masalah. Masalah yang biasa timbul adalah masalah konsumen. Masalah konsumen adalah masalah yang diakibatkan oleh pelaku usaha karena telah melanggar hak konsumen. Seharusnya pelaku usaha menjamin dan menjaga hak konsumen agar tidak dilanggar sehingga tidak terjadi masalah. Hubungan pelaku usaha dan konsumen tidak lepas dari unsur di luar pihak-pihak tersebut, seperti masalah nilai-nilai keagamaan, ketenagakerjaan, tanggung jawab sosial dan lain-lain. Salah satu masalah yang ditimbulkan oleh pelaku usaha seperti halnya berbuat curang dengan memanipulasi berat bersih, isi bersih atau netto yang mereka jual belikan dan menawarkan barang seolah sesuai dengan standar mutu. Dengan begitu maka keuntungan para pelaku usaha akan lebih meningkat dan sebaliknya konsumen akan merasa sangat dirugikan dengan hal tersebut. Penelitian ini bertujuan untuk pemenuhan hak-hak yang dimiliki konsumen dalam transaksi jual beli menurut Undang-Undang Nomor 8 Tahun 1999 tentang perlindungan konsumen. Oleh karena itu untuk mengetahui dan membahas lebih mengenai perlindungan hukum terdapat dalam rumusan masalah dalam penelitian hukum ini yaitu bagaimana perlindungan hukum terhadap konsumen akibat pelaku usaha yang menjual barang tidak sesuai dengan Undang-Undang Perlindungan Konsumen dan bagaimana sanksi hukum dalam putusan pengadilan nomor 462/Pid.Sus/2017/Pn. Mdn. Penulisan hukum ini menggunakan metode penelitian yuridis normatif, jenis data yang digunakan adalah data sekunder, metode pendekatan yang digunakan adalah pendekatan terhadap Undang-Undang, dan analisis data dalam menggunakan analisis kualitatif untuk mengetahui perlindungan hukum terhadap konsumen dalam transaksi jual beli barang yang tidak sesuai dengan Undang-Undang Nomor 8 Tahun 1999 Tentang perlindungan konsumen./ Legal protection for consumers is one type of legal protection. Consumer protection cannot be separated from buying and selling activities, in Indonesia currently consumer protection is getting good attention because it involves rules to create people's welfare. With the Consumer Law Protection Act and other legal instruments, consumers have equal rights and positions and they can sue or sue if it turns out that their rights have been violated or harmed by business actors. Legal protection occurs because there is a problem. The problem that usually arises is a consumer problem. Consumer problems are problems caused by business actors because they have violated consumer rights. Business actors should guarantee and maintain consumer rights so that they are not violated so that problems do not occur. The relationship between business actors and consumers cannot be separated from elements outside these parties, such as issues of religious values, employment, social responsibility and others. One of the problems caused by business actors, such as cheating by manipulating the net weight, net content or net value of what they sell and buy and offering goods as if they are in accordance with quality standards. That way, the profits of business actors will increase and on the contrary consumers will feel very disadvantaged by this. This study aims to fulfill the rights of consumers in buying and selling transactions according to Law Number 8 of 1999 concerning consumer protection. Therefore, to find out and discuss more about legal protection contained in the formulation of the problem in this legal research, namely how is legal protection for consumers due to business actors who sell goods that are not in accordance with the Consumer Protection Act and how are legal sanctions in court decisions number 462/Pid .Sus/2017/Pn. Mdn. This legal writing uses normative juridical research methods, the type of data used is secondary data, the approach method used is an approach to the law, and data analysis uses qualitative analysis to determine legal protection for consumers in buying and selling goods that are not in accordance with Law Number 8 of 1999 concerning consumer protection.
