Abstract

Tanah merupakan karunia TUHAN Yang Maha Esa kepada seluruh umat manusia di atas muka bumi ini, dan bahkan sejak lahir sampai meninggal dunia, manusia senantiasa akan membutuhkan tanah untuk tempat tinggal dan juga menjadi sumber kehidupan” (Bernard Limbong.2013) dan “Tanah adalah merupakan hak yang unik dan terbatas. oleh karena itu ia berharga. Barangsiapa menguasai tanah tersebut, juga menguasai potensi modal yang menguntungkan” (Samun Ismaya,2013). Sehubungan dengan modal, penanaman modal bagi negara Indonesia mempunyai arti yang sangat penting bagi pembangunan ekonomi nasional sebagai tujuan yang hendak dicapai melalui Undang-undang Nomor 25 Tahun 2007 Tentang Penanaman Modal namun masih menghadapi permasalahan dan tantangan dalam pelaksanaanya,termasuk sengketa antara penanam modal dan masyarakat. Pembentukan Bank Tanah merupakan terobosan menyelesaikan permasalahan tanah dan menarik minat investasi melalui omnibuslaw Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, Hasil penelitian, keberadaan Bank Tanah yang memiliki kewenangan khusus akan dapat memberikan manfaat kepada masyarakat dan kepastian hukum kepada investor yang menanamkan modalnya, namun berdasarkan hasil penelitian beberapa peneliti sebelumnya, Investasi melalui Bank Tanah perlu membentuk ketentuan yang bersifat khusus ( Lex Spesialis ) saat perubahan Undang-Undang Cipta Kerja yang telah diputuskan oleh Mahkamah Konstitusi berdasarkan Putusan Nomor 91/PUU-XVIII/2020, termasuk merubah prosedur pelayanan administrasi pertanahan berbasis digital. Kata Kunci: ..Kepastian Hukum, Bank Tanah, Penanaman Modal./ "Land is a gift from God Almighty to all mankind on this earth, and even from birth to death, humans will always need land for shelter and also a source of life" (Bernard Limbong. 2013) and "Land is is a unique and limited right. therefore it is valuable. Whoever controls the land, also controls the potential for profitable capital” (Samun Ismaya, 2013). With regard to capital, investment for the Indonesian state has a very important meaning for national economic development as a goal to be achieved through Law Number 25 of 2007 concerning Investment but still faces problems and challenges in its implementation, including disputes between investors and the community. . The establishment of the Land Bank is a breakthrough in solving land problems and attracting investment through the omnibus law of Law Number 11 of 2020 concerning Job Creation, The results of the study, the existence of a Land Bank that has special authority will be able to provide benefits to the community and legal certainty to investors who invest their capital, but based on the results of several previous researchers, Investment through the Land Bank needs to form special provisions (Lex Specialists) when the Law changes -The Job Creation Law which has been decided by the Constitutional Court based on Decision Number 91/PUU-XVIII/2020, including changing the procedures for digital-based land administration services.
