Title : Analisis Hukum Terhadap Pembentukan dan Eksistensi Peraturan Daerah Nomor 1 Tahun 2014 Tentang Rencana Detail Tata Ruang dan Peraturan Zonasi di Provinsi DKI Jakarta D. Key Words : Rencana Detail Tata Ruang, Eksistensi, Masyarakat. Pembentukan Peraturan Dearah Nomor 1 Tahun 2014 tentang Rencana Detail Tata Ruang dan Peraturan Zonasi menimbulkan ketidakpastian hukum bagi sebahagian masyarakat Jakarta dan para pengusaha/swasta. Hal ini disebabkan karena penetapan Peraturan Zonasi terhadap ruang/tanah yang mereka miliki tidak sesuai dengan peruntukan kegiatan usahanya maupun bangunannya. Penelitian ini mengkaji bagaimana proses pembentukan Perda Rencana Detail Tata Ruang dan Peraturan Zonasi (RDTR dan PZ) apakah sudah sesuai dengan asas pembentukan Peraturan Perundang-undangan yang baik, serta untuk mengetahui eksistensi Perda RDTR dan PZ terhadap kehidupan masyarakat Prov. DKI Jakarta. Penelitian ini menggunakan pendekatan Perundang-undangan (state approach) dan pendekatan kasus atau (case approach). Penelitian ini bersifat kualitatif dengan metode yuridis formil, yaitu menggali sumber dari hasil studi kepustakaan, dan pendekatan normatif yaitu metode yang menekankan pada penggunaan data sekunder dan data primer. Metode pengumpulan data penelitian berupa wawancara mendalam, pengamatan lapangan, analisis Peraturan Perundang-undangan, Peraturan Daerah. Penelitian ini menyimpulkan bahwa, Pembentukan Peraturan Daerah Nomor 1 Tahun 2014 tentang RDTR dan PZ sudah mengikuti ketentuan yang diatur dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, dan Peraturan Menteri Dalam Negeri Nomor 80 Tahun 2015 sebagaimana telah diubah dalam Peraturan Menteri Dalam Negeri Nomor 120 Tahun 2018 tentang Pembentukan Produk Hukum Daerah. Sementara itu, eksistensi Peraturan Daerah Nomor 1 Tahun 2014 tentang RDTR dan PZ terhadap kehidupan masyarakat Provinsi DKI Jakarta sudah tidak relevan lagi, karena kondisi eksisting tata ruang Kota Jakarta banyak terjadi pelanggaran tata ruang, serta pembangunan infrastruktur yang dilakukan oleh Pemerintah Pusat dan Pemerintah Daerah belum diatur dalam Perda RDTR dan PZ./ A. Title : Legal Analysis Of The Establishment And Existence Of Regional Regulation Number 1 Of 2014 Concerning Detailed Spatial Plan And Zonation Regulation In DKI Jakarta Province. D. Key Words : Detailed Spatial Planning, Existence, Society. The formation of Regional Regulation Number 1 of 2014 concerning Detailed Spatial Planning and Zoning Regulations creates legal uncertainty for some of the people of Jakarta and entrepreneurs / private companies. This is because the stipulation of the Zoning Regulation on the space/land they own is not in accordance with the designation of their business activities and the building. This research examines how the process of forming the Regional Regulation on Detailed Spatial Planning and Zoning Regulations is in accordance with the principles of establishing good laws and regulations, as well as to find out the existence of the Regional Regulation on Detailed Spatial Planning and Zoning Regulations on the lives of the people of Prov. DKI Jakarta. This study uses a statutory approach and a case approach. This research is qualitative with formal juridical methods, namely exploring sources from the results of literature studies, and a normative approach, namely methods that emphasize the use of secondary data and primary data. Research data collection methods in the form of in-depth interviews, field observations, analysis of statutory regulations, regional regulations. This study concludes that, the establishment of Regional Regulation Number 1 of 2014 concerning Detailed Spatial Planning and Zoning Regulations has followed the provisions stipulated in Law Number 12 of 2011 concerning the Establishment of Legislation and Regulation of the Minister of Home Affairs Number 80 of 2015 as has been amended in the Regulation of the Minister of Home Affairs Number 120 of 2018 concerning the Establishment of Regional Legal Products. Meanwhile, the existence of Regional Regulation Number 1 of 2014 concerning Detailed Spatial Planning and Zoning Regulations on the lives of the people of DKI Jakarta Province is no longer relevant, because the existing conditions of the Jakarta City spatial planning have many violations of spatial planning, as well as infrastructure development carried out by the Central Government and the Regional Government has not been regulated in the Regional Regulation on Detailed Spatial Planning and Zoning Regulations.
