Abstract

Peraturan perundang-undangan tentang Merek penting untuk terus diperbaharui agar memastikan adanya peraturan hukum yang mengatur dan menjamin kepastian hukum terkait penggunaan dan pemanfaatan Merek. Protokol Madrid yang dikelolah oleh World Intellectual Property Organization (WIPO) adalah suatu protokol yang memungkinkan seseorang untuk mendapatkan dan mempertahankan perlindungan untuk Mereknya di seluruh dunia dengan adanya suatu sistem pendaftaran dan pengelolaan terpusat. Indonesia telah meratifikasi Protokol Madrid melalui Peraturan Presiden Nomor 92 Tahun 2017. Namun dengan diratifikasinya suatu perjanjian internasional, maka ketentuan perjanjian tersebut harus diterapkan, dan penerapannya itu yang harus dipikirkan oleh Pemerintah agar dapat diberlakukan bagi masyarakat. Penelitian ini bertujuan menjelaskan latar belakang ratifikasi Protokol Madrid yang dilakukan oleh Pemerintah Indonesia dan menggambarkan penerapan Protokol Madrid di Indonesia. Penelitian ini mengunakan metode penelitian hukum normatif dengan pendekatan undang-undang. Dalam penelitian, data yang digunakan adalah data sekunder yaitu data hasil penelitian kepustakaan dengan menggunakan bahan hukum primer, sekunder, dan tersier. Teori utilitas dan teori sistem hukum menjadi pisau analisis dalam membedah rumusan masalah yang diangkat. Dari hasil penelitian diketahui bahwa Indonesia sebagai negara berdaulat tidak diwajibkan mengesahkan Protokol Madrid, namun melakukannya sebagai bentuk partisipasinya sebagai bagian dari masyarakat global dan demi memperoleh manfaatnya bagi masyarakat. Penerapan Protokol Madrid di Indonesia dilakukan berdasarkan Peraturan Pemerintah Nomor 22 Tahun 2018./It is important that laws and regulations on Trademarks be continuously updated in order to ensure that there are legal regulations that regulate and guarantee legal certainty regarding the use and utilization of Trademarks. The Madrid Protocol administered by the World Intellectual Property Orgaization (WIPO) is a protocol that allows a person to obtain and maintain protection for their Trademark worldwide with a centralized registration and management system. Indonesia has ratified the Madrid Protocol through Presidential Regulation Number 92 of 2017. However, with the ratification of an international agreement, the provisions of the agreement must be applied, and its implementation must be considered by the Government so that it can be applied to the community. This study aims to explain the background of the ratification of the Madrid Protocol by the Government of Indonesia and to describe the application of the Madrid Protocol in Indonesia. This study uses a normative legal research method with a statute approach and comparative approach. In this research, the data used are secondary data, name data resulting from library research using primary, secondary, and tertiary legal materials. The utility theory and the legal system theories are the tools used to dissect the problems raised in this study. The result of the research shows that Indonesia as sovereign country is not obliged to ratify the Madrid Protocol, but has done so as a form of participation as party of the global community and to obtain the benefits for its people. The application of the Madrid Protocol in Indonesia is based on the Government Regulation Number 22 of 2018.
