Abstract

Covid-19 yang terjadi pada akhir tahun 2019 membuat kerugian dibidang perekonomian. Di Indonesia banyaknya perusahaan yang mengalami kerugian Covid–19 yang di karenakan pemerintah menerapkan PSBB, termaksud pada Perusahaan Jasa Konstruksi. Dengan keadaan seperti ini banyak perusahaan yang tidak bisa membayar gaji sehingga pegawai diberlakukan penerapan asas no work no pay pada masa pandemi dengan alasan force majeure. Metode skripsi ini menggunakan metode penelitian hukum yuridis normatif. Teknik pendekatan penelitian ini meggunakan Teknik penelitian perundang-undangan. Sumber hukum dari penelitian hukum dengan menerapkan bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum yaitu dengan studi perpustakaan. Tenik analisis bahan hukum mengunakan metode hukum normatif. Teknik kesimpulan dari penelitian ini menggunakan Teknik deduktif. Penerapan asas no work no pay dengan alasan force majeure dapat digunakan di Perusahaan Jasa Konstruksi jika dalam perjanjiannya dituliskan force majeure. Dalam Perjanjian harus disebutkan force majeure yang sesuai pada Pasal 47 ayat (1) Undang-undang Nomor 2 Tahun 2017 Tentang Jasa Konstruksi. Perusahaan yang dinyatakan terkena dampak Covid-19 dapat berpegangan dengan Surat Edaran Menteri Ketenagakerjaan Nomor M/3/HK- 04/III/2020 tentang perlindungan pekerja dan usaha dalam rangka pencegahan dan penggulangan Covid-19 yang dikeluarkan oleh pemerintah untuk perlindungan pekerja/buruh. Kata Kunci : Asas No Work No Pay, Covid-19,Perusahaan Jasa Konstruksi, force majeure / Covid-19, which occurred at the end of 2019, made economic losses. In Indonesia, many companies have suffered losses due to COVID-19 due to the government implementing PSBB, including Construction Service Companies. With conditions like this, many companies cannot pay salaries, so employees apply the no work no pay principle during the pandemic on the grounds of force majeure. This thesis method uses a normative juridical legal research method. The technique of this research approach uses statutory research techniques. Legal sources from legal research by applying primary and secondary legal materials. The process of collecting legal materials is by studying the library. The method of analyzing legal materials uses normative legal methods. The conclusion technique of this research uses deductive approach. The application of the no work no pay principle by reason of force majeure can be used in a Construction Service Company if the agreement is written force majeure. In the agreement, the force majeure must be stated in accordance with Article 47 paragraph (1) of Law Number 2 of 2017 concerning Construction Services. Companies that are declared to be affected by Covid-19 can adhere to the Circular Letter of the Minister of Manpower Number M/3/HK-04/III/2020 concerning the protection of workers and businesses in the context of preventing and controlling Covid-19 issued by the government for the protection of workers/laborers.
