Abstract

Teknologi digital saat ini telah merambah ke seluruh penjuru dunia dengan cepat, dan teknologi ini tidak lagi hanya didominasi oleh lapisan tertentu, namun telah juga dinikmati oleh hampir seluruh lapisan masyarakat dunia. Dalam keadaan seperti itu akhirnya memacu pengembangan teknologi dengan cepat sebab potensi ekonomi yang didapatkan cukup besar. Hal ini juga yang membuat perkembangan teknologi ini menyasar ke dunia industri musik yang sangat berpotensi untuk menyerap teknologi itu secara besar-besaran. Dunia industri musik telah hidup dalam kemasan teknologi ini sehingga memberikan kemudahan-kemudahan yang dapat dinikmati oleh masyarakat sehingga berpotensi untuk melanggar aturan yang ada. Undang-undang Hak Cipta pada awalnya dirumuskan untuk industri musik yang tidak memperhitungkan tentang adanya pengaruh teknologi baru, namun hal tersebut telah di gilas oleh adanya teknologi ini. Hukum selalu tertinggal adalah salah satu pernyataan yang tepat, sebab realitas dalam lingkungan kehidupan akan selalu berubah dengan cepat meninggalkan aturan yang ada. Pengaruh dari hal tersebut sangat signifikan dalam kehidupan manusia, karena kerugian yang ditanggung oleh manusia sangat besar baik dari segi materil maupun immateril. Penelitian ini bertujuan untuk mengungkap permasalahan-permasalahan yang terjadi akibat hadirnya teknologi yang baru serta pengaruhnya terhadap kehidupan dalam industri musik di Indonesia, dan kaitannya dengan Undang-undang Hak Cipta yang telah dirumuskan dan diberlakukan di negara Indonesia. Pada saat-saat ini adalah saat yang sulit bagi industri musik khususnya di Indonesia karena saat inilah masa yang dapat dikatakan sebagai masa transisi dari industri musik secara analog ke industri musik secara digital. Dalam proses produksi hingga proses publikasi telah dilakukan melalui teknologi digital ini. Sesungguhnya Undang-undang telah diubah agar dapat sejalan dengan dunia teknologi digital, namun hal tersebut masih memerlukan pembenahan-pembenahan dalam hal struktur hukum, substansi hukum dan budaya hukumnya. Untuk mendapatkan hasil yang maksimal maka penelitian ini dilakukan melalui jenis penelitian hukum normatif/doktrinal (normative legal research)/Today's digital technology has penetrated all corners of the world rapidly, and this technology is no longer only dominated by certain layers, but has also been enjoyed by almost all levels of the world's society. In such circumstances, eventually spur the development of technology quickly because the economic potential obtained is quite large. This also makes the development of this technology target the world of the music industry which has the potential to absorb the technology on a large scale. The world of the music industry has lived in this technology package so as to provide conveniences that can be enjoyed by the public so that it has the potential to violate existing rules. Copyright law was originally formulated for the music industry which did not take into account the influence of new technology, but it has been crushed by this technology. The law is always left behind is one of the right statements, because the reality in the world of life will always change quickly leaving the existing rules. The influence of this is very significant in human life, because the losses borne by humans are very large both in terms of material and immaterial. This study aims to reveal the problems that occur due to the presence of new technology and its influence on life in the music industry in Indonesia, and its relation to the Copyright Law that has been formulated and enforced in Indonesia. These are difficult times for the music industry, especially in Indonesia, because this is a period that can be said to be a transition period from the analogue music industry to the digital music industry. In the production process to the publication process has been done through this digital technology. In fact, the law has been changed to be in line with the world of digital technology, but it still requires improvements in terms of legal structure, legal substance and legal culture. To get maximum results, this research is conducted through the type of normative legal research.
