Abstract

Penelitian ini membahas perlindungan hukum terhadap pencipta atas penggunaan karya untuk tujuan komersial tanpa izin berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Metode yang digunakan adalah penelitian normatifyuridis melalui analisis peraturan perundang-undangan dan literatur hukum terkait. Hasil penelitian menunjukkan bahwa pencipta memiliki hak ekonomi dan hak moral yang wajib dihormati, serta negara menyediakan perlindungan preventif melalui pendaftaran ciptaan dan pengaturan lisensi, serta perlindungan represif melalui gugatan perdata dan sanksi pidana bagi pelanggar. Meskipun kerangka hukum sudah tegas, implementasinya masih terkendala oleh rendahnya kesadaran hukum masyarakat dan pengawasan yang belum optimal di ruang digital. Oleh karena itu, diperlukan peningkatan edukasi publik dan penguatan penegakan hukum agar perlindungan hak cipta dapat berjalan lebih efektif dan memberikan kepastian hukum bagi pencipta. Kata Kunci: Hak Cipta, Perlindungan Hukum, Penggunaan Komersial Tanpa Izin, Pertanggungjawaban Hukum. / This study examines legal protection for creators against unauthorized commercial use of works under Law Number 28 of 2014 concerning Copyright. The method used is normative-juridical research through analysis of laws and related legal literature. The results of the study indicate that creators have economic and moral rights that must be respected, and the state provides preventive protection through registration of works and licensing arrangements, as well as repressive protection through civil lawsuits and criminal sanctions for violators. Although the legal framework is clear, its implementation is still hampered by low public legal awareness and suboptimal oversight in the digital space. Therefore, increased public education and strengthened law enforcement are needed so that copyright protection can be more effective and provide legal certainty for creators.
