Abstract

Usaha mikro, kecil, dan menengah (UMKM) seharusnya tidak memiliki hambatan yang datang seperti kereta barang dari sistem sekitarnya seperti kegagalan menetapkan kebijakan hukum yang jelas dan peraturan yang rumit. Kami berharap dapat menemukan cermin yang realistik antara regulasi di Daerahnya Yogyakarta dan Studi Banding UMKM di kota Depok tentang politik hukum dengan kontribusinya dalam menggerakkan perekonomian nasional Indonesia. Dampak iklim politik di tingkat negara bagian dan nasional terhadap legislasi UMKM terlebih dahulu diteliti, kemudian pertimbangan-pertimbangan yang mempengaruhi pembuatan kebijakan daerah. Dengan menggunakan metodologi yuridis-normatif dan yuridis-empiris, penelitian ini mengkaji peraturan perundang-undangan dan kasus hukum terkait kota Depok serta wawancara mendalam dengan tokoh UMKM setempat, pejabat pemerintah dan legislator. Hasil penelitian menunjukkan bahwa pendekatan hukum kebijakan Depok terhadap UMKM masih bias dan ekslusif. Meski sudah ada Peraturan Walikota Nomor 15 Tahun 2021, namun kebijakan komprehensif tanpa peraturan daerah (Perda) yang mengakomodir UMKM masih dalam tahap awal pembangunan. Sebaliknya, DIY telah memiliki kebijakan yang komprehensif seperti Perda nomor 6 tahun 2022 dan Pergub nomor 58 tahun 2023 mulai dari undang-undang yang tegas hingga insentif fiskal, perlindungan hukum, dan akses pinjaman. Langkah signifikan untuk mengatasi hambatan akses permodalan dari catatan buruk di SLIK OJK telah dilakukan di tingkat nasional melalui pemberlakuan Peraturan Pemerintah Nomor 47 Tahun 2024 tentang pemberantasan kredit macet UMKM. "Untuk kebangkitan UMKM, kebijakan ini merupakan campuran hukuman dan promosi untuk mengulurkan tangan membantu. Pembangunan ekosistem UMKM yang inklusif, responsif, dan berkelanjutan melibatkan reformasi politik hukum berbasis keadilan distributif (Rawls theory) reaktivitas legislasi UMKM dengan memberdayakan konteks lokal sinergi antara pemerintah pusat dan daerah./Micro, small and medium-sized businesses (MSMBs) should not have obstacles that come like a freight train from the surrounding system such as failure to set clear legal policy and complex regulations. We will expect to find a realistic mirror between regulations in the D.I.Y Special Region of Yogyakarta and Comparative Studies in the city of Depok on legal politics MSMEs with its contribution to drive national economy Indonesia. The impact of the political climate at the state and national level on MSME legislation is first examined, then considerations that influence regional policymaking. Utilizing a juridical-normative and juridical-empirical methodology, this study examines the bylaws and case law related to Depok city as well as in-depth interviews with local MSME figures, government officials and legislators. The results indicate that the legal approach of Depok policies to MSMEs is still biased and exclusivist. Although there is a Mayor Regulation Number 15 the Year 2021, but the comprehensive policy without local regulations (Perda) that accommodated MSMEs is still in its early stages of development. On the contrary, DIY has had a comprehensive policy such as Perda number 6 of 2022 and Pergub number 58 of 2023 from forceful laws to fiscal incentives, legal protections, and loan access. A significant step to overcome barriers for capital access from bad records in the OJK SLIK has been made at the national level through the enactment of Government Regulation Number 47 Year 2024 regarding eradication of MSME bad credit. "For the revival of MSMEs, this policy is a mixed bag of punishment and promotion to lend a helping hand. Construction of a MSME ecosystem that is inclusive, responsive and sustainable involve reforming distributive justice-based legal politics (Rawls theory) reactivity the legislation of MSME by empowering the local context the synergy between central and local government.
