Abstract

Konser musik merupakan sarana hiburan dan telah menjadi komponen penting dalam gaya hidup dan kebutuhan emosional masyarakat. Promotor kerap menjadikan konser sebagai wadah untuk melakukan kecurangan. Kasus yang belakangan terjadi yaitu penundaan pengembalian konser musik oleh promotor. Meskipun terdapat regulasi perlindungan konsumen, implementasinya di lapangan sering tidak sesuai membuat konsumen dalam ketimpangan informasi, dan kurangnya transparansi dari promotor. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan perundang-undangan dan konseptual. Data yang digunakan untuk penelitian ini adalah jenis data sekunder berupa bahan hukum primer menggunakan Kitab Undang-Undang Hukum Perdata dan Undang-Undang Perlindungan Konsumen, bahan hukum sekunder terdiri dari hasil penelitian, atau buku teks yang relavan dengan penelitian, serta bahan hukum tersier berupa kamus, bibliografi dan sumber lainnya yang kemudian dijadikan satu untuk dianalisis. Dari hasil penelitian ini disimpulkan bahwa penundaan pengembalian dana tiket konser musik menunjukkan posisi konsumen yang masih lemah dibandingkan pelaku usaha, meskipun hak dan kewajiban keduanya telah diatur dalam UUPK. UUPK dihadirkan untuk memberikan perlindungan dan kepastian hukum bagi konsumen, dan konsumen diberi hak untuk menuntut pengembalian dana melalui mekanisme penyelesaian sengketa, baik secara litigasi maupun non-litigasi agar haknya dapat terpenuhi secara adil./ Music concerts are a means of entertainment and have become an important component of people's lifestyles and emotional needs. In organizing a music concert, of course, it is necessary to involve many parties including promoters, prospective audiences. However, promoters often use concerts as a forum for cheating. The latest case is the delay in the return of music concerts by promoters. Despite the existence of consumer protection regulations, their implementation in the field is often inappropriate, leaving consumers in a weak position due to information inequality, and lack of transparency from promoters. This research is a normative law research that uses a legislative and conceptual approach. The data used for this study is a type of secondary data in the form of primary legal materials using the Civil Code and the Consumer Protection Law, secondary legal materials consist of Draft Laws, research results, textbooks that are relevant to the research, and tertiary legal materials in the form of dictionaries, bibliographies and other sources which are then used as one for analysis. From the results of this study, it is concluded that the delay in the refund of music concert tickets shows that the position of consumers is still weak compared to business actors, even though the rights and obligations of both have been regulated in the Consumer Protection Law. The UUPK was presented to provide legal protection and certainty for consumers, and consumers are given the right to demand a refund through dispute resolution mechanisms, both litigation and non-litigation so that their rights can be fulfilled fairly.
