Abstract
Praktik rangkap jabatan pejabat negara pada sistem admistrasi negara indonesia merupakan suatu isu yang bukan saja baru dalam perjalanan negara indonesia. Dalam penyelenggaraan negara rangkap jabatan bertentangan dengan Asas Pemerintahan yang Baik (AUPB) yang mencerminkan nilai moral, etika, profesionalitas dan akuntabilitas untuk mewujudkan pemerintahan yang baik (Good Governance). Mengacu pada latar belakang tersebut, penelitian ini hendak merumuskan masalah. satu, Bagaimana ketentuan hukum dan mekanisme rangkap jabatan oleh pejabat negara menurut peraturan perundang-undangan di indonesia ?. dua, bagaimana mekanisme pengawasan dan upaya hukum pencegahaan, guna mengatasi praktik rangkap jabatan menurut peraturan perundang-undangan di indonesia?. Dengan metode penelitian jenis yuridis normatif, dengan melakukan metode pendekatan penelitian yaitu pendekatan perundang-undangan (stateapproach) dan pendekatan konseptual serta jenis dan sumber data penelitian bedasarkan bahan hukum premier, bahan hukum sekunder dan bahan hukum tersier kemudian disusun secara sistematis. Penelitian rangkap jabatan pada penerapannya bertentangan dengan kepastian hukum oleh karenananya penulis menyimpulkan bahawa praktik rangkap jabatan sangat merugikan pemerintahan di indonesia karena berkaitan dengan profesionalitas dan akuntabilitas pejabat negara itu sendiri. konflik kepentingan menjadikan seorang pejabat negara lebih mengutamakan kepentingan individu ataupun kelompok dibanding kepentingan untuk masyarakat. Kata kunci: Rangkap Jabatan, pemerintahaan Baik, Administrasi Negara/ The practice of dual positions held by state officials in the administrative system of Indonesia is an issue that is not only new in the journey of the Indonesian state. In the administration of the state, holding dual positions contradicts the Principles of Good Governance (AUPB), which reflect moral values, ethics, professionalism, and accountability to realize good governance. Therefore, This research is performed with the formulation of two main problems: first, what arethe legal provisions and mechanisms regarding dual positions held by state officials according to the regulatory and legal instruments in Indonesia? Second, what are the mechanisms for supervision and legal efforts to prevent and address the practice of dual positions according to the laws and regulations in Indonesia? This study adopts a normative juridical research method, utilizing both a statutory approach and a conceptual approach. The data utilized in this research is derived from three categories of legal materials primary, secondary, and tertiary which are subsequently organized in a systematic manner. This research demonstrates that the practice of holding dual positions conflicts with legal certainty, and consequently, the author argues that this practice is substantially damaging to the interests of the Indonesian government, as it relates to the professionalism and accountability of state officials themselves. Conflicts of interest cause state officials to prioritize personal or group interests over the interests of the public. Keyword: Positions Framework, Good Governance, State Administration
