Abstract
Judul Tesis: PENYITAAN TERHADAP ASET KRIPTO DALAM PENEGAKAN HUKUM OLEH PENYIDIK POLRI DALAM PEMBAHARUAN HUKUM PIDANA Penelitian ini membahas urgensi formulasi peraturan Kepolisian Negara Republik Indonesia (Polri) dalam penyitaan aset kripto sebagai dasar penegakan hukum di Indonesia, di tengah pesatnya perkembangan teknologi blockchain dan aset digital seperti Bitcoin serta Ethereum. Latar belakang masalah menyoroti bagaimana aset kripto semakin dimanfaatkan dalam kejahatan siber, pencucian uang, dan pendanaan terorisme, sementara regulasi existing seperti Kitab Undang- Undang Hukum Acara Pidana (KUHAP) dan Undang-Undang TPPU belum sepenuhnya mengakomodasi sifat desentralisasi, anonimitas, dan lintas yurisdiksi aset kripto. Rumusan masalah difokuskan pada pengaturan penyitaan aset kripto dalam pembaruan hukum pidana serta kendala dan upaya yang dihadapi penyidik Polri, dengan tujuan menganalisis kesenjangan regulasi dan memberikan rekomendasi adaptif. Dalam kerangka pemikiran, penelitian mengadopsi teori pembaruan hukum, penegakan hukum, dan hukum progresif dari Sudarto, Barda Nawawi Arief, serta Satjipto Rahardjo, untuk menganalisis konsep penyidikan, penyitaan, aset kripto, dan cyber crime. Temuan menunjukkan bahwa penyitaan aset kripto menghadapi kendala seperti ketiadaan otoritas sentral, kesulitan akses private key, regulasi yang belum komprehensif, serta keterbatasan infrastruktur dan kapasitas penyidik Polri. Upaya yang dilakukan mencakup pelacakan melalui analisis blockchain, kerja sama internasional dengan Interpol dan FATF, serta penyimpanan aset dalam cold wallet, meskipun masih bergantung pada pedoman Kejaksaan Nomor 7 Tahun 2023. Kesimpulan menyatakan bahwa pengaturan penyitaan aset kripto didasarkan pada KUHAP Pasal 39, UU TPPU, dan rekomendasi FATF, tetapi memerlukan pembaruan untuk mengatasi sifat unik aset digital. Saran meliputi pengembangan regulasi khusus, SOP penyitaan aset kripto, pelatihan forensik digital bagi penyidik, peningkatan koordinasi internasional, serta mekanisme pengelolaan dan pelelangan aset sitaan yang transparan. Penelitian ini berkontribusi secara praktis bagi Polri dalam meningkatkan efektivitas penegakan hukum dan secara teoritis dalam pengembangan hukum adaptif terhadap inovasi digital. Kata kunci: Aset kripto, penyitaan, penegakan hukum, blockchain, regulasi. / Thesis Title: SEIZURE OF CRYPTOCURRENCY ASSETS IN LAW ENFORCEMENT BY INDONESIAN NATIONAL POLICE (POLRI) INVESTIGATORS WITHIN THE RENEWAL OF CRIMINAL LAW This study addresses the urgency of formulating regulations for the Republic of Indonesia Police (Polri) regarding the seizure of crypto assets as a foundation for law enforcement in Indonesia, amid the rapid development of blockchain technology and digital assets such as Bitcoin and Ethereum. The background highlights how crypto assets are increasingly exploited in cybercrimes, money laundering, and terrorism financing, while existing regulations, such as the Code of Criminal Procedure (KUHAP) and the Anti-Money Laundering Law (UU TPPU), have yet to fully accommodate the decentralized, anonymous, and cross- jurisdictional nature of crypto assets. The research focuses on the regulatory framework for crypto asset seizure within criminal law reform, as well as the challenges and efforts faced by Polri investigators, aiming to analyze regulatory gaps and provide adaptive recommendations. Within its theoretical framework, the study adopts the theories of legal reform, law enforcement, and progressive law from Sudarto, Barda Nawawi Arief, and Satjipto Rahardjo to analyze the concepts of investigation, seizure, crypto assets, and cybercrime. Findings indicate that crypto asset seizure faces obstacles such as the absence of a central authority, difficulties in accessing private keys, incomplete regulations, and limitations in Polri’s infrastructure and investigator capacity. Efforts undertaken include transaction tracing through blockchain analysis, international cooperation with Interpol and FATF, and asset storage in cold wallets, though these still rely on the Attorney General’s Guidelines Number 7 of 2023. The study concludes that the regulation of crypto asset seizure is based on KUHAP Article 39, UU TPPU, and FATF recommendations, but requires updates to address the unique characteristics of digital assets. Recommendations include developing specific regulations, standard operating procedures (SOPs) for crypto asset seizure, digital forensic training for investigators, enhanced international coordination, and transparent mechanisms for managing and auctioning seized assets. This research contributes practically to improving Polri’s law enforcement effectiveness and theoretically to developing adaptive legal frameworks for digital innovation.
