Abstract
The unlawful transfer of land rights may cause losses to purchasers acting in good faith, particularly when legal defects in the transfer process are unknown at the time of the transaction. This situation creates legal uncertainty and highlights the need for adequate legal protection for good-faith purchasers. This research aims to examine the forms and legal bases of protection for good-faith purchasers in criminal acts involving the transfer of land rights under Indonesian laws and regulations, as well as to analyze the judges’ legal considerations in Decision Number 875/Pdt.G/2019/PN Jkt.Brt and their conformity with the principles of justice and legal certainty. This research employs the theory of legal protection and the theory of legal certainty as its analytical framework. The method used is normative legal research with statutory and case approaches. The legal materials consist of primary, secondary, and tertiary legal sources, which are analyzed qualitatively. The results of this research indicate that legal protection for good-faith purchasers has been regulated under the Basic Agrarian Law and its implementing regulations and is further supported by jurisprudence. Such protection is granted to purchasers who have complied with legal procedures and acted in good faith. Furthermore, the judges’ legal considerations in Decision Number 875/Pdt.G/2019/PN Jkt.Brt have, in principle, taken into account the purchaser’s good faith and provided legal certainty regarding the acquired land rights, thereby aligning with the principles of justice and legal certainty, although there remains room for improvement in strengthening legal protection.
