Abstract

Pada saat ini penegakan hukum pelanggaran lalu lintas sebagian besar telah menggunakan teknologi Electronic Traffic Law Enforcement (ETLE). Berdasarkan pengamatan penulis terdapat permasalahan-permasalahan penegakan hukum yang timbul dari celah hukum yang dimiliki oleh ETLE, mulai dari penggunaan TNKB palsu, TNKB yang tidak digunakan, hingga TNKB yang sengaja disamarkan. Oleh karena hal itu, diperlukan analisis yuridis yang mendalam guna menganalisis efektivitas ETLE dalam melakukan penegakan pelanggaran lalu lintas. Metode penelitian yang diterapkan dalam kajian ini adalah metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan sebagai kerangka analisisnya. Adapun sumber data yang digunakan berupa bahan hukum primer, sekunder dan tersier disertai Data Pendukung berupa Data Primer untuk memperkuat argumen akan penelitian yang diteliti. Melalui penelitian penulis, dapat diketahui bahwa di dalam penegakan pelanggaran lalu lintas melalui ETLE terdapat permasalahan atau fenomena yang timbul dari factor masyarakat guna menghindari penegakan melalu ETLE. Adapun fenomena tersebut ternyata tergolong Kembali sebagai pelanggaran lalu lintas yang mana telah diatur di dalam Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Sehingga tentunya diperlukan penegakan hukum secara seimbang baik melalui ETLE maupun secara konvensional guna mengatasi fenomena yang timbul dari celah hukum ETLE. /Currently, traffic law enforcement is largely conducted using Electronic Traffic Law Enforcement (ETLE) technology. Through the author's observations, several law enforcement issues have emerged from legal loopholes within the ETLE system, ranging from the use of fake license plates and the removal of license plates to the intentional disguising of plates. Consequently, a comprehensive legal analysis is required to analyze the effectiveness of ETLE in enforcing traffic regulations. This study adopts a normative legal research method, applying a statutory approach as the primary analytical framework. The data sources consist of primary, secondary, and tertiary legal materials, supplemented by primary data as supporting evidence to strengthen the research arguments. Results of this researchconclude that in the enforcement of traffic violations through ETLE, there are issues or phenomena arising from public behavior aimed at evading ETLE detection. These phenomena are, in fact, classified as traffic violations as regulated under Law Number 22 of 2009 concerning Traffic and Road Transportation. Therefore, a balanced law enforcement approach—combining both ETLE and conventional methods—is necessary to address the phenomena arising from ETLE’s legal loopholes.
