Abstract

Implementasi prinsip fair use dalam penggunaan fitur Instagram Music terhadap kebebasan pengaturan aransemen musik serta perlindungan hak pencipta, dengan diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan terms of use Instagram Music. Penggunaan musik dalam konten digital, khususnya dalam media sosial seperti contohnya Instagram, semakin marak. Namun, pemanfaatan musik tersebut seringkali menimbulkan permasalahan terkait hak cipta. Penelitian ini bertujuan untuk mengkaji sejauh mana penerapan prinsip fair use dalam konteks penggunaan musik di Instagram dapat mengakomodasi kreativitas para pengguna dalam mengaransemen musik, sekaligus melindungi hak-hak para pencipta. Melalui pendekatan yuridis normatif, penelitian ini menganalisis mengenai ketentuan hukum yang berlaku, putusan-putusan pengadilan, serta literatur terkait. Hasil penelitian diharapkan dapat memberikan kontribusi dalam pengembangan pemahaman mengenai implementasi prinsip fair use di Indonesia, khususnya dalam konteks industri kreatif digital./ The Implementation of the Fair Use Principle in the Use of Instagram Music Feature on the Freedom to Arrange Musical Arrangements and the Protection of Copyright, with Reference to Law Number 28 of 2014 on Copyright and Instagram Music Terms of Use. The use of music in digital content, especially on social media platforms such as Instagram, is increasingly prevalent. However, the utilization of such music often raises copyright issues. This research aims to examine to what extent the application of the fair use principle in the context of music use on Instagram can accommodate users' creativity in arranging music, while simultaneously protecting the rights of creators. Through a normative legal approach, this research analyzes the applicable legal provisions, court decisions, and relevant literature. The research findings are expected to contribute to the development of understanding regarding the implementation of the fair use principle in Indonesia, particularly in the context of the digital creative industry.
