Abstract

ABSTRAK Berbagai ketentuan hukum terkait dengan bongkar muat barang berbahaya telah dikeluarkan oleh pemerintah. Namun dalam pelaksanaannya di Pelabuhan Kelas II Raja Ampat telah terjadi 2 kali kejadian pencemaran yang disebabkan oleh kegiatan bongkar muat barang berbahaya. Padahal Raja Ampat sebagai kawasan konservasi alam yang seharusnya terbebas dari segala bentuk pencemaran. Berdasarkan hal tersebut fokus penelitian ini terkait dengan regulasi hukum yang berlaku mengatur tentang penanganan bongkar muat barang berbahaya di di Pelabuhan kelas II Raja Ampat dan sejauh mana efektifitasnya serta kendala dan tantangan dalam implementasi regulasi hukum terkait dengan bongkar muat barang berbahaya di Pelabuhan kelas II Raja Ampat. Jenis penelitian ini termasuk dalam penelitian yuridis empiris, dengan pendekatan sosiologi hukum dan perundang- undangan. Lokasi penelitian dilakukan di Pelabuhan Kelas II Raja Ampat. Sumber data primer diperoleh melalui wawancara dan data sekunder melalui buku, jurnal dan penelitian terkait. Teknik pengumpulan data melalui observasi, wawancara dan studi pustaka. Proses bongkar muat barang berbahaya di Pelabuhan Kelas II Raja Ampat berdasar atas SOP bongkar muat yang berlandaskan atas Undang-undang Nomor 17 tahun 2008 tentang Pelayaran, PP Nomor 20 tahun 2010 tentang Angkutan di Perairan dan Peraturan Menteri Perhubungan nomor 16 Tahun 2021 tentang Tata Cara Penanganan dan Pengangkutan Muatan Barang Berbahaya. Kegiatan bongkar muat barang berbahaya pada Pelabuhan Kelas II Raja Ampat telah memehuni aspek efektifitas hukum pada aspek hukum, penegak hukum, budaya hukum dan masyarakat. Namun pada aspek sarana dan fasilitas tidak sesuai dengan kebutuhan sehingga kegiatan bongkar muat barang berbahaya dinyatakan tidak efektif.. Kata Kunci : Efektivitas, Bongkar Muat, dan Barang Berbahaya. / ABSTRACT Various legal provisions regarding the handling of dangerous goods loading and unloading have been issued by the government. However, in practice, at the Class II Port of Raja Ampat, there have been two incidents of pollution caused by the handling of dangerous goods. Despite Raja Ampat being a natural conservation area that should be free from any form of pollution. Based on this, the focus of this research is related to the applicable legal regulations governing the handling of dangerous goods loading and unloading at the Class II Port of Raja Ampat, and the extent of their effectiveness as well as the obstacles and challenges in implementing these legal regulations related to the handling of dangerous goods loading and unloading at the Class II Port of Raja Ampat. This type of research falls under empirical juridical research, with a socio-legal and legislative approach. The research location is conducted at the Class II Port of Raja Ampat. Primary data sources are obtained through interviews, while secondary data are obtained from books, journals, and related research. Data collection techniques include observation, interviews, and literature study. The process of handling dangerous goods loading and unloading at the Class II Port of Raja Ampat is based on loading and unloading SOPs grounded in Law Number 17 of 2008 concerning Shipping, Government Regulation Number 20 of 2010 concerning Transportation in Waters, and Minister of Transportation Regulation Number 16 of 2021 concerning Procedures for Handling and Transporting Dangerous Goods. The handling of dangerous goods loading and unloading activities at the Class II Port of Raja Ampat meets the legal effectiveness aspects in terms of legal, law enforcement, legal culture, and society. However, in terms of facilities and infrastructure, they do not meet the necessary requirements, resulting in the handling of dangerous goods loading and unloading activities being deemed ineffective.
