Abstract
Jual beli tanah harus dilakukan dihadapan PPAT dan dibuktikan dengan Akta Jual Beli (AJB) untuk memberikan kepastian hukum. Namun, praktik jual beli tanah di bawah tangan dengan kuitansi masih umum terjadi karena prosesnya lebih sederhana meskipun beresiko secara hukum. Rumusan masalah dalam skripsi ini adalah apakah tanda bukti jual beli tanah berdasarkan kuitansi dapat dikatakan sah menurut hukum dan apakah pertimbangan Hakim dalam memutus perkara Putusan Nomor 217/Pdt.G/2022/PN PBR sudah sesuai dengan ketentuan hukum yang berlaku. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus atau case approach. Data yang digunakan adalah data sekunder berupa bahan hukum primer: Kitab Undang-Undang Perdata, Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran tanah, Peraturan Pemerintah Nomor 34 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah dan Surat Edaran Mahkamah Agung (SEMA) Nomor 4 Tahun 2016 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2016, sedangkan bahan hukum primer diperoleh dari buku-buku, jurnal dan lain sebagainya, bahan hukum tersier yaitu berupa kamus dan penelusuran internet, kemudian bahan hukum yang terkumpul disusun dan dianalisis. Dari hasil penelitian ini, dapat disimpulkan bahwa tanda bukti jual beli tanah dengan kuitansi tidak dapat dianggap sah menurut hukum sebab Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran tanah, Peraturan Pemerintah Nomor 34 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah dan Surat Edaran Mahkamah Agung (SEMA) Nomor 4 Tahun 2016 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2016 mengharuskan jual beli tanah dilakukan dihadapan pejabat akta tanah dan dibuktikan dengan akta otentik. Selain itu, putusan hakim dalam kasus Putusan Pengadilan Negeri Pekanbaru Nomor 217/Pdt.G/2022/PN Pbr belum seuai dengan hukum agraria yang berlaku. Akan tetapi hakim mensahkan jual beli tanah dalam putusan ini dengan mempertimbangkan Pasal 1457 dan bukti-bukti yang diajukan Penggugat. Kata kunci : Jual beli, Tanah, Kuitansi. / Land sale and purchase must be done in front of a PPAT and proven by a Sale and Purchase Deed (AJB) to provide legal certainty. However, the practice of buying and selling land under the hands with receipts is still common because the process is simpler even though it is legally risky. The formulation of the problem in this thesis is whether the proof of sale and purchase of land based on receipts can be said to be valid according to the law and whether the Judge's consideration in deciding Case No. 217/Pdt.G/2022/PN PBR is in accordance with applicable legal provisions. This research is a normative legal research with a case approach. The data used is secondary data in the form of primary legal materials: Civil Code, Law Number 5 of 1960 on Basic Agrarian Principles, Government Regulation Number 24 of 1997 on Land Registration, Government Regulation Number 34 of 1998 on the Regulation of the Position of Land Deed Officials and Supreme Court Circular Letter (SEMA) Number 4 of 2016 on the Enforcement of the Formulation of the Results of the 2016 Plenary Meeting of the Supreme Court Chamber, while primary legal materials are obtained from books, journals and so on, tertiary legal materials in the form of dictionaries and internet searches, then the collected legal materials are compiled and analysed. From the results of this research, it can be concluded that proof of sale and purchase of land with receipts cannot be considered valid according to the law because Law Number 5 of 1960 concerning Basic Agrarian Principles, Government Regulation Number 24 of 1997 concerning Land Registration, Government Regulation Number 34 of 1998 concerning Regulations on the Position of Land Deed Officials and Supreme Court Circular Letter (SEMA) Number 4 of 2016 concerning the Implementation of the Formulation of the Results of the 2016 Plenary Meeting of the Supreme Court Chamber requires that the sale and purchase of land be carried out in front of a land deed official and proven by an authentic deed. In addition, the judge's decision in the case of Pekanbaru District Court Decision Number 217/Pdt.G/2022/PN Pbr is not in accordance with applicable agrarian law. However, the judge legalized the sale and purchase of land in this decision by considering Article 1457 and the evidence submitted by the plaintiff.
