Abstract

Karena manusia dan tanah memiliki hubungan yang begitu erat, diyakini bahwa mereka memiliki kesamaan mental satu sama lain. Oleh karena itu umum bagi pemilik tanah untuk melindungi properti mereka dengan cara apapun ketika hak mereka dilanggar. Dalam penelitian ini, peneliti menyoroti permasalahan mengapa sertifikat hak milik tanah dibeli melalui lelang eksekusi jaminan hipotik dan bagaimana penyelesaian kepemilikan sertifikat hak milik yang dibeli melalui lelang eksekusi jaminan hak tanggungan Peneliti menggunakan metodologi penelitian yuridis normatif yang mengacu pada konsep, teori, dan teknik analisis. Data primer yang penulis gunakan untuk penelitian ini adalah bahan hukum primer seperti UUD 1945, Peraturan Pemerintah Nomor 10 Tahun 1961 tentang Pendaftaran Tanah, Peraturan Pemerintah Nomor 5 Tahun 1960 tentang Peraturan Pokok, PokokPokok Agraria, dan Peraturan Negara. Menteri Agraria/Kepala Badan Pertanahan Nasional No. 3 Tahun 1997. Kemudian bahan hukum sekunder berupa makalah penelitian akademis, artikel profesional, dan publikasi yang memberikan hasil penelitian. Sebagai akibat dari keputusan Pejabat Tata Usaha Negara, dalam hal ini Badan Pertanahan Simalungun, gugatan tersebut diajukan oleh penggugat ke Pengadilan Tata Usaha Negara Medan, menurut temuan penelitian.Tergugat ternyata menerbitkan sertifikat baru atas tanah milik penggugat, dan majelis hakim memerintahkan Kepala Kantor Pertanahan Kabupaten Simalungun untuk mencabut sertifikat hak milik No. 236/Desa Karang Anyer dan surat ukur No. 217/Karang Anyer /2016 karena diterbitkan tanpa kehatihatian dan melanggar undang-undang yang mengatur pendaftaran tanah. / It is said that because of the close connection between people and the land, they develop a ental affinity for one another. This view holds that when their rights are infringed, landowners frequently defend their property in any means. In this study, the researcher focused on two key issues: the rationale behind the acquisition of land title certificates through the execution auction of mortgage guarantees, and the best way to deal with the ownership of certificates for property rights acquired through such a process. A normative juridical research approach is used by researchers,drawing on concepts,heories, and analytical methods. The 1945 Constitution, Government Regulation Number 10 of 1961 concerning Land Registration, Government Regulation Number 5 of 1960 concerning Basic Regulations, Fundamentals of Agrarian Affairs, and egulation of the State Minister for Agrarian Affairs/Head of the National Land Agency No.3 of 1997 were the primary legal sources that the authors used for this study. Then there is secondary legal information, which may be found in publications that present study findings, professional articles, and academic research papers. The study's conclusions include that the plaintiff filed a complaint with the Medan State Administrative Court as a result of a decision made by the State Administrative Officer, in this case the Simalungun Land Agency. The panel of judges ordered the head of the Simalungun District Land Office to revoke certificate of ownership No. 236/Desa Karang Anyer and measurement letter No. 217/Karang Anyer/2016 because they were issued carelessly and in violation of the law governing land registration. It was discovered that the defendant had issued a new certificate on the plaintiff's property.
