Abstract

ABSTRAK Dalam penelitian ini, akan dilakukan analisis terhadap perspektif tanggung jawab perdata dalam penyelesaian ganti rugi atas kecelakaan kapal di Indonesia. Studi kasus putusan pengadilan negeri akan digunakan untuk memperoleh pemahaman yang lebih baik mengenai penyelesaian sengketa terkait kecelakaan kapal dalam konteks tanggung jawab perdata. Penelitian ini akan membahas beberapa faktor yang dapat mempengaruhi penyelesaian sengketa terkait kecelakaan kapal, seperti peran pengadilan negeri dalam menyelesaikan sengketa, prosedur penyelesaian sengketa, serta aspek-aspek hukum lain yang terkait dengan penyelesaian sengketa terkait kecelakaan kapal. Dua rumusan masalah dalam penelitian ini, yaitu: (1) Apakah hasil dari analisis tanggung jawab perdata dalam penyelesaian ganti rugi atas kecelakaan kapal di Indonesia (Studi Kasus Putusan Pengadilan Negeri No: 6/Pdt.G/2021/PN Pbl dan Putusan Mahkamah Pelayaran No: HK. 212/14/IX/MP.022) dan (2) Bagaimana perbandingan pertimbangan Hakim melalui Putusan Pengadilan Negeri dengan Putusan Mahkamah Pelayaran terhadap Kasus tersebut (Studi Kasus Putusan Pengadilan Negeri No: 6/Pdt.G/2021/PN Pbl dan Putusan Mahkamah Pelayaran No: HK. 212/14/IX/MP.022). Berdasarkan judul penelitian tesis ini, jenis penelitian yang diangkat merupakan Penelitian Yuridis Normatif (penelitian hukum kepustakaan). Adapun sumber data dalam penelitian ini yaitu data sekunder. Data sekunder adalah data-data yang diperoleh dari studi kepustakaan. Data sekunder dalam bidang hukum dipandang dari sudut kekuatan mengikatnya dapat dibedakan menjadi 3 (tiga), yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier Penelitian ini menggunakan pendekatan kasus (case approach) dan pendekatan undang-undang (statuta approach). Metode analisis yang digunakan adalah metode normatif kualitatif, yakni penelitian dengan menguraikan kondisi maupun fakta-fakta tentang objek penelitian. Adapun hasil penelitian ini yaitu, Perspektif Tanggung Jawab Perdata dalam Penyelesaian Ganti Rugi atas Kecelakaan Kapal di Indonesia (Studi Kasus Putusan Pengadilan Negeri dan Putusan Mahkamah Pelayaran) dapat disimpulkan bahwa Putusan Mahkamah Pelayaran hanya bersifat limitatif yaitu tidak menyebutkan mengenai ganti rugi Perusahaan Pelayaran kepada pemilik barang, dikarenakan kompetensi dan yuridiksi yang dimiliki Mahkamah Pelayaran sangat terbatas. Mahkamah Pelayaran hanya sebatas menjatuhkan hukuman yang bersifat administratif terhadap seorang Nahkoda. Dalam Putusan Pengadilan Negeri menghukum Tergugat I, II dan III untuk memberikan ganti rugi kepada Penggugat secara materil, sedangkan pada Putusan Mahkamah Pelayaran hanya Nahkoda saja yang diberikan sanksi, yaitu Nahkoda dari KM Jala Karya Sukses Abadi dan Nahkoda KM Sanjaya Fisherindo yang masing-masing diberikan sanksi administratif selama 1 (satu) bulan dan 2 (dua) bulan. Kata Kunci: Kecelakaan Kapal, Tanggung Jawab Perdata, Pengangkutan Laut. / ABSTRACT In this research, an analysis will be carried out on the perspective of civil liability in resolving compensation for ship accidents in Indonesia. Case studies of district court decisions will be used to gain a better understanding of the resolution of disputes related to ship accidents in the context of civil liability. This research will discuss several factors that can influence the resolution of disputes related to ship accidents, such as the role of district courts in resolving disputes, dispute resolution procedures, as well as other legal aspects related to resolving disputes related to ship accidents. Two problem formulations in this research, namely: (1) What are the results of the analysis of civil liability in resolving compensation for ship accidents in Indonesia (Case Study of District Court Decision No: 6/Pdt.G/2021/PN Pbl and Shipping Court Decision No: HK. 212/14/IX/MP.022) and (2) How does the Judge's consideration in the District Court Decision compare with the Shipping Court's Decision on the Case (Case Study of District Court Decision No: 6/Pdt.G/2021/PN Pbl and Shipping Court Decision No: HK. 212/14/IX/MP.022). Based on the title of this thesis research, the type of research undertaken is Normative Juridical Research (librarian law research). The data source in this research is secondary data. Secondary data is data obtained from literature study. Secondary data in the legal field viewed from the perspective of its binding strength can be divided into 3 (three), namely primary legal materials, secondary legal materials, and tertiary legal materials. This research uses a case approach (case approach) and a statutory approach (statue approach). The analytical method used is a qualitative normative method, namely research by describing the conditions and facts about the research object. The results of this research, namely, the Perspective of Civil Liability in Settlement of Compensation for Ship Accidents in Indonesia (Case Study of District Court Decisions and Shipping Court Decisions) can be concluded that the Shipping Court Decision is only limited in nature, that is, it does not mention compensation for Shipping Companies to the owners of goods. , because the competence and jurisdiction of the Shipping Court is very limited. The Shipping Court is only limited to imposing administrative penalties on a Master. In the District Court's Decision, Defendants I, II and III were sentenced to provide material compensation to the Plaintiff, whereas in the Shipping Court's Decision only the Master was given sanctions, namely the Master of KM Jala Karya Sukses Abadi and the Master of KM Sanjaya Fisherindo who were respectively given administrative sanctions for 1 (one) month and 2 (two) months.
