Abstract

ABSTRAK Judul : ASPEK HUKUM PERLINDUNGAN KONSUMEN PELANGGAN INDIHOME DALAM PENERAPAN PRINSIP - PRINSIP GOOD CORPORATE GOVERNANCE Tujuan penelitian untuk mengetahui dan menganalisis hak – hak konsumen Indihome dalam hal pelayanan standar yang disepakati berdasarkan tarif/jaringan berdasarkan prinsip-prinsip good corporate governance serta untuk mengetahui dan menganalisis pelaksanaan tanggungjawab Indihome sebagai pelaku usaha sudah sesuai dengan asas-asas perlindungan konsumen dalam penerapan prinsip - prinsip good corporate governance. Jenis penelitian yang dipergunakan dalam penyusunan penulisan ini adalah penelitian yuridis normatif, yaitu penelitian yang menganalisis hukum yang diputuskan oleh hakim melalui proses pengadilan dengan cara meneliti data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil Penelitian perjanjian yang telah disepakati memang tidak selalu berjalan sesuai dengan kenyataannya. PT. Telkom dalam hal ini bertindak sebagai penyedia layanan IndiHome memiliki kontrak berlangganan IndiHome. Apabila konsumen menyatakan ia merasa dirugikan akibat terjadinya gangguan layanan tersebut dan dapat terbukti pula bahwa konsumen tersebut sedang atau telah mengalami gangguan layanan dan terbukti bahwa gangguan tersebut karena kelalaian PT. Telkom, maka akan diberikan ganti rugi berupa benefit seperti gratis berlangganan dibulan berikutnya atau tidak membayar sesuai dengan ketentuan di bulan berikutnya. Jika pelaku usaha mengabaikan hak-hak konsumen maka dalam hal ini konsumen dilindungi oleh Undang-Undang Perlindungan Konsumen. Dalam kasus ini PT. Telkom tidak melakukan kewajibannya sebagai pelaku usaha menurut Undang-Undang No. 8 Tahun 1999 tentang Perlindungan konsumen yang didasarkan pada asas kepastian hukum yang dimaksudkan supaya pelaku usaha maupun konsumen menaati hukum dan memperoleh keadilan dalam penyelenggaraan perlindungan konsumen, serta negara menjamin kepastian hukum. Dengan tidak dipenuhinya kewajiban pelaku usaha maka hal tersebut melanggar hak-hak konsumen yang diatur pada Pasal 4 Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen dan juga melanggar asas keadilan, yang mana asas keadilan dimaksudkan agar partisipasi seluruh rakyat dapat diwujudkan secara maksimal dan memberikan kesempatan kepada konsumen dan pelaku usaha untuk memperoleh haknya dan melaksanakan kewajibannya secara adil. Kata kunci: GOOD CORPORATE GOVERNANCE, indihome,Telkomsel. / ABSTRACT Title : LEGAL ASPECTS OF CONSUMER PROTECTION OF INDIHOME CUSTOMERS IN THE APPLICATION OF GOOD CORPORATE GOVERNANCE PRINCIPLES The purpose of the study is to know and analyze the rights of Indihome consumers in terms of agreed standard services based on tariffs/networks based on the principles of good corporate governance and to find out and analyze the implementation of Indihome's responsibilities as business actors in accordance with the principles of consumer protection in the application of the principles of good corporate governance. The type of research used in the preparation of this writing is normative juridical research, which is research that analyzes the law decided by judges through the court process by examining secondary data consisting of primary legal material, secondary legal material, and tertiary legal material. Research results agreements that have been agreed do not always run in accordance with reality. PT. Telkom in this case acts as an IndiHome service provider having an IndiHome subscription contract. If the consumer states that he feels aggrieved due to the service interruption and it can also be proven that the consumer is or has experienced service interruption and it is proven that the disruption is due to the negligence of PT. Telkom, then compensation will be given in the form of benefits such as free subscription in the following month or not paying according to the provisions in the following month. If business actors ignore consumer rights, in this case consumers are protected by the Consumer Protection Law. In this case PT. Telkom does not perform its obligations as a business actor according to Law No. 8 of 1999 concerning Consumer Protection which is based on the principle of legal certainty which is intended so that business actors and consumers obey the law and obtain justice in the implementation of consumer protection, and the state guarantees legal certainty. By not fulfilling the obligations of business actors, it violates consumer rights regulated in Article 4 of Law Number 8 of 1999 concerning Consumer Protection and also violates the principle of justice, where the principle of justice is intended so that the participation of all people can be realized optimally and provide opportunities for consumers and business actors to obtain their rights and carry out their obligations fairly.
