Abstract

ABSTRAK Undang-undang Nomor 23 Tahun 2002 tentang Perlindungan Anak merupakan peraturan khusus yang mengatur mengenai masalah anak. Tujuan dari perlindungan anak sendiri disebutkan dalam Pasal 3 Undang-undang No 23 Tahun 2002. Penelitian dilakukan untuk mengkaji: (1) Apakah kendala yang dialami dalam melakukan perlindungan terhadap anak sebagai korban pelecehan seksual ditinjau dari pembaharuan hukum pidana dan (2) Bagaimana langkah kepolisian dalam melakukan perlindungan hukum terhadap anak sebagai korban pelecehan seksual pasca perubahan Undang-Undang Perlindungan Anak ditinjau dari pembaharuan hukum pidana Jenis penelitian yang dipergunakan ketika penyusunan tesis ialah penelitian yuridis normatif (metode penelitian hukum normatif). Penelitian ini mengkaji dan menganalisis bahan-bahan pustaka berupa peraturan perundang-undangan, putusan pengadilan, dan literatur-literatur yang berkaitan dengan permasalahan yang akan dibahas. Metode pendekatan masalah berbeda dengan metode atau tipe penelitian dalam upaya memecahkan permasalahan yang diambil. Dari hasil penelitian di peroleh bahwa Pembaharuan hukum pidana merupakan salah satu upaya penting untuk meningkatkan perlindungan terhadap anak korban pelecehan seksual. Namun, perlu diingat bahwa pembaruan hukum pidana hanyalah salah satu aspek dari upaya perlindungan terhadap anak korban pelecehan seksual.. Selanjutnya, Langkah Kepolisian dalam melakukan Perlindungan Hukum terhadap Anak sebagai Korban Kejahatan Seksual Pasca Perubahan Undang-Undang Perlindungan Anak Ditinjau Dari Pembaharuan Hukum Pidana, tidak hanya dilihat dari perubahan Undang-Undang Perlindungan Anak, tetapi juga dapat dilihat melalui UU TPKS memberikan perlindungan hukum yang lebih komprehensif bagi korban pelecehan seksual. Teori kebijakan kriminal merupakan salah satu teori yang dapat digunakan untuk menganalisis langkah-langkah yang diambil oleh aparat penegak hukum, dalam hal ini kepolisian, dalam menangani kasus kejahatan seksual terhadap anak. Kata Kunci: Perlindungan Hukum, Pelecehan Seksual, dan anak. / ABSTRACT Law No. 23/2002 on Child Protection is a specific regulation governing child issues. The purpose of child protection itself is mentioned in Article 3 of Law No 23 of 2002. The research was conducted to examine: (1) What are the obstacles experienced in protecting children as victims of sexual abuse in terms of criminal law reform and (2) What are the steps taken by the police in providing legal protection to children as victims of sexual abuse after the amendment of the Child Protection Law in terms of criminal law reform. The type of research used when preparing the thesis is normative juridical research (normative legal research method). This research examines and analyses library materials in the form of laws and regulations, court decisions, and literature related to the problems to be discussed. The method of approaching the problem is different from the method or type of research in an effort to solve the problems taken. From the results of the research, it was found that criminal law reform is one of the important efforts to improve protection for child victims of sexual disclosure. However, it should be remembered that criminal law reform is only one aspect of efforts to protect child victims of decency. Furthermore, the police's steps in providing legal protection to children as victims of sexual crimes after the amendment of the Child Protection Law are seen from the Criminal Law Reform, not only seen from the amendment of the Child Protection Law, but also can be seen through the TPKS Law providing more comprehensive legal protection for victims of sexual disclosure. Criminal policy theory is one of the theories that can be used to analyse the steps taken by law enforcement officials, in this case the police, in handling cases of sexual crimes against children.
