Abstract

Dalam penulisan skripsi ini, penulis membahas tentang Perlindungan Hukum Terhadap Pencipta Karya Cipta Lagu dalam Hal Pemungutan dan Pendistribusian Royalti. Terdiri dari dua rumusan masalah yang membahas tentang perlindungan hukum terhadap pencipta karya lagu di bidang performing rights. Serta mekanisme pembayaran royalti. Penggunaan karya lagu di bidang perfotrming rights banyak terjadi dan dalam penggunaan lagu di bidang performing rights seorang user harus membayar royalti. Metode penelitian yang digunakan penulis dalam penulisan skripsi ini adalah Yuridis Normatif, yang dilakukan dengan bahan hukum primer berupa perundangan – undangan, serta bahan hukum sekunder. Penulis menganalisis dan mengkaji tentang perlindungan hukum terhadap pencipta karya lagu dalam pendistribusian dan pemungutan royalti. Penulis menyimpulkan bahwa penggunaan lagu di bidang performing rights bisa terlaksana, bila user telah mendapat izin serta membayar royalti terhadap pnggunaan lagu. Dan seseorang meningkatkan kesadaran diri terhadap peggunaan lagu, karena jika tidak maka hal tersebutb masuk ke dalam pelanggaran hak cipta. / In writing this thesis, the author discusses Legal Protection for Song Copyright Authors in terms of Collection and Distribution of Royalties. It contains two problem formulations that discuss legal protection for songwriters in the field of performing rights. As well as royalty payment mechanisms. The use of song works in the field of performing rights occurs a lot and in the use of songs in the field of performing rights a user has to pay royalties. The research method used by the author in writing this thesis is Normative Juridical, which is carried out with primary legal materials in the form of legislation, as well as secondary legal materials. The author analyzes and examines the legal protection of songwriters in the distribution and collection of royalties. The writer concludes that the use of songs in the field of performing rights can be implemented, if the user has obtained permission and paid royalties for the use of the song. And someone increases self-awareness about the use of songs, because if not then it is included in copyright infringement
