Abstract

Aset digital dan blockchain adalah fenomena global baru dimana konsep digitalisasi dengan menggunakan teknologi blockchain dan di era revolusi industri 4.0, fenomena ini sudah mulai dapat dimengerti oleh masyarakat dan di beberapa negara, sudah diadopsi dan diakui legalitasnya. Perkembangan dan disrupsi teknologi ini bertujuan untuk memberikan keakuratan, transparansi dan terutama dengan sistim desentralisasi yang memberikan kontrol kepada komunitas di masyarakat, sedangkan konsep aset digital adalah produk yang berwujud didalam sistem blockchain tersebut, dengan tujuan untuk menjadi alat pertukaran, alat pembayaran, alat penyimpanan data, alat investasi dan sebagainya. Fokus permasalahan yang dikaji dalam penelitian ini adalah bagaimana kedudukan hukum atas aset digital di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif kualitatif dengan pendekatan normatif. Peneliti mengolah data dengan analisis data kualitatif. Dalam praktek hukum dan kebijakan atas pengaturan aset digital di Indonesia, aset digital adalah sebagai alat investasi komoditi yang dapat diperdagangkan di Bursa Berjangka. Pengaturan yang bersifat teknis diatur oleh Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti) dibawah Kementerian Perdagangan, dengan Peraturan Bappebti Nomor 13 Tahun 2022 Tentang Perubahan Atas Peraturan Bappebti Nomor 8 Tahun 2021. Beleid tersebut mengatur Pedoman Penyelenggaraan Perdagangan Pasar Fisik Aset Kripto (Crypto Asset) di Bursa Berjangka. Penerbitan aturan baru ini bertujuan untuk memperkuat ekosistem aset kripto dan blockchain di Indonesia, yang terus berkembang pesat di Indonesia hingga saat ini penelitian dilakukan. Kata kunci: Aset Digital, Kripto, Blockchain, Disrupsi Teknologi, Komoditi. / Digital assets and blockchain is a new global phenomenon, whereby the concept of digitization uses blockchain technology. In the era of the industrial revolution 4.0, this phenomenon has begun to be understood and adopted by the public and in many countries, the legality of digital assets and blockchain have been recognized and adopted. The aim of this technological development and disruption is to provide namely accuracy and transparency; along with a decentralized system, which gives control to myriad of communities in society; while the concept digital assets are tangible products within the blockchain system, with the aim of being a means of exchange, means of payment, means of storing data, means of investment. The focus of the issues studied in this research is the analysis legal standing of digital assets in Indonesia. For this research, the research method used is a qualitative normative legal research method, with a normative approach. The researcher processes the data with qualitative data analysis. Following legal practice and policy on digital asset regulation in Indonesia, digital assets are a commodity investment tool that can be traded on the Futures Exchange. Technical arrangements are regulated by the Commodity Futures Trading Regulatory Agency (Bappebti) under the Ministry of Trade, with CoFTRA Regulation Number 13 of 2022 concerning Amendments to CoFTRA Regulation Number 8 of 2021. The regulation regulates Guidelines for Organizing Crypto Asset Physical Market Trading in Futures Exchange. Until this research was conducted, the digital assets and blockchain ecosystem in Indonesia continues to develop and grow rapidly in Indonesia. The issuance of this new regulation aims to strengthen crypto asset and blockchain industry and its ecosystem. Keywords: Digital Asset, Crypto, Blockchain, Technological Disruption, Commodity.
