Abstract

ABSTRAK Nama : Shinta Meilani Hasibuan NIM : 2102190016 Judul : Perlindungan Hukum Bagi Perempuan Dalam Prespektif Undang-Undang Penghapusan Tindak Pidana Kekerasan Seksual. Adapun ujuan dari penelitian ini ada dua, yaitu pertama adalah untuk mengetahui konstruksi Perlindungan Hukum terhadap Perempuan yang terdapat di dalam Undang-Undang Nomor 12 Tahun 2022; dan kedua adalah untuk mengetahui hambatan dan tantangan yang mungkin terdapat dalam penerapan Perlindungan Hukum terhadap Perempuan di dalam Undang-Undang Nomor 12 Tahun 2022. Beberapa teori yang dipergunakan dalam penelitian ini antara lain adalah teori keadilan dari Aristoteles yang diulas oleh Theo Huijbers, teori kepastian hukum dari Gustav Radbruch, dan teori perlindungan korban atau viktimologi. Metode yang dipakai dalam penelitian ini adalah metode yuridis normatif dengan pertimbangan bahwa titik tolak penelitian analisis terhadap peraturan perundang-undangan. Adapun pendekatan yang digunakan dalam penelitian ini adalah menggunakan pendekatan perundang-undangan dimana dalam pengumpulan bahan penelitian ini dilakukan dengan cara library research. Hasil dari penelitian ini adalah sudah adanya perlindungan hukum yang komprehensif, adanya pengakuan terhadap ragam tindakan kekerasan seksual, adanya pembentukan lembaga perlindungan seperti P2TP2A, adanya peningkatan sanksi hukum, dan adanya pemberdayaan korban. Kata Kunci: Tindak Pidana, Undang-Undang Tindak Pidana, Kekerasan Seksual. / ABSTRACT Name : Shinta Meilani Hasibuan NIM : 2102190016 Title : Legal Protection for Women in the Perspective of the Law on the Elimination of Sexual Violence Crimes The objectives of this research are as follows: first, to find out the construction of Legal Protection of Women contained in the Law No. 12 of 2022; and second, to find out the obstacles and challenges that may exist in the application of Legal Protection of Women in Law No. 12 of 2022. Some of the theories used in this research include Aristotle's theory of justice reviewed by Theo Huijbers, Gustav Radbruch's theory of legal certainty, and the theory of victimology. The method that is used in this research is the normative juridical method with the consideration that the starting point of the research is the analysis of laws and regulations. The approach that is used in this research is to use a legislative approach where the material gathered in this research is done by using library research. The results of this study are the existence of comprehensive legal protection, the recognition of various acts of sexual violence, the establishment of protection institutions such as P2TP2A, the increase in legal sanctions, and the empowerment of victims.
