Abstract

Di Indonesia Pemutusan Hubungan Kerja secara sepihak banyak terjadi dikarenakan sistem yang dilakukan tidak sesuai apa yang tercantum dalam Undang-undang, karena pada dasarnya Pemutusan Hubungan Kerja seharusnya terjadi karena persetujuan dari kedua belah pihak mengetahui bahwa hubungan kerja akan berakhir dan telah melakukan upaya untuk mempersiapkannya. Rumusan masalah dalam skripsi ini adalah Bagaimana perlindungan hukum terhadap pekerja/buruh yang di PHK secara sepihak menurut Undang-undang Nomor 13 Tahun 2003 dan Apa akibat hukumnya bagi Pengusaha jika melakukan PHK secara sepihak pada pekerja/buruh berdasarkan Putusan Nomor 495 K/Pdt.Sus-PHI/2015.
 Dalam penulisan skripsi ini penulis menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (Case Approach), Jenis data yang digunakan adalah data sekunder, berupa bahan hukum primer: Kitab Undang-undang Hukum Perdata, Undang-undang Nomor 13 Tahun 2003 Ketenagakerjaan dan Putusan Mahkamah Agung Nomor 495 K/Pdt.Sus- PHI/2015, sedangkan bahan hukum sekunder diperoleh dari buku-buku maupun literatur lain. 
 Dari hasil penelitian dapat disimpulkan dalam melakukan Pemutusan Hubungan Kerja (PHK) perlu dilakukan sesuai prosedur yang seharusnya yang ketentuannya terdapat dalam Undang-undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan pada Pasal 150 s.d. Pasal 172 agar tidak terjadi Pemutusan Hubungan Kerja secara Sepihak atau dengan tidak sewenangnya. Dan Perusahaan juga perlu memperhatikan syarat- syarat dalam membuat Perjanjian Kerja agar tidak keliru dan bisa membedakan antara Perjanjian Kerja Waktu Tertentu dengan Perjanjian Kerja Waktu Tidak Tertentu. Kata Kunci: Pemutusan Hubungan Kerja Secara Sepihak. 
/ In Indonesia, many unilateral terminations of employment occur because the system implemented is not in accordance with what is stated in the law, because basically termination of employment should occur due to the agreement of both parties knowing that the employment relationship will end and have made efforts to prepare for it. The formulation of the problem in this thesis is how is the legal protection for workers/laborers who are laid off unilaterally according to Law Number 13 of 2003 and what are the legal consequences for employers if they carry out unilateral termination of workers/laborers based on Decision Number 495 K/Pdt.Sus-PHI/2015. In writing this thesis the author uses normative legal research methods with a statutory approach (statute approach) and case approach (case approach), The type of data used is secondary data, in the form of primary legal materials: Civil Code, Law Number 13 of 2003 on Employment and Supreme Court Decision Number 495 K/Pdt.Sus-PHI/2015, while secondary legal materials were obtained from books and other literature. From the results of the study it can be concluded that termination of employment (PHK) needs to be carried out according to the proper procedure, the provisions of which are contained in Law Number 13 of 2003 concerning Manpower in Articles 150 s.d. Article 172 so that termination of employment relations occurs unilaterally or not arbitrarily. And companies also need to pay attention to the conditions in making work agreements so that they are not mistaken and can distinguish between a specified time work agreement and an unspecified time work agreement.
