Abstract

Penggabungan perusahaan adalah suatu perusahaan yang ada bergabung dengan perusahaan lainnya. Dilakukan penggabungan perusahaan merupakan upaya perusahaan agar tetap bisa bertahan, hal ini menjadi pilihan strategis dalam bisnis/ kegiatan usaha perseroan terbatas. Saat melakukan penggabungan perusahaan akan timbul dampak terhadap hubungan kerja bagi pekerja/buruh dan upaya-upaya perlindungan hukumnya. Penggabungan perusahaan akan memberikan sinergi baru yang mempunyai daya saing yang tinggi. Akibat terhadap hubungan kerja bagi pekerja/buruh yang digabungkan bisa baik yaitu pekerja/buruh tetap bekerja dan mendapatkan kesejahteraan yang meningkat, dan bisa tidak kurang baik karena pekerja/buruh dapat dikenakan pemutusan hubungan kerja. Penelitian ini merupakan penelitian hukum dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Pengumpulan bahan melalui metode studi literature, dengan bahan hukum primer maupun sekunder. Selanjutnya bahan hukum dikaji dan dianalisis dengan pendekatan-pendekatan yang digunakan dalam penelitian ini menjawab isu hukum dalam penelitian ini. Pemutusan Hubungan Kerja yang terjadi terhadap pekerja akibat penggabungan perusahaan dapat menimbulkan perselisihan hubungan industrial yakni perselisihan pemutusan hubungan kerja. Perselisihan pemutusan hubungan kerja terjadi akibat adanya perbedaan pendapat antara pekerja dan pengusaha ketika terjadi pemutusan hubungan kerja. Upaya hukum yang dapat ditempuh pekerja dalam hal terjadinya perselisihan pemutusan hubungan kerja yakni dengan upaya penyelesaian di luar Pengadilan Hubungan Industrial dimulai dari upaya bipartite, kemudian tahap mediasi ataupun konsiliasi dan penyelesaian perselisihan pemutusan hubungan kerja melalui lembaga peradilan yaitu Pengadilan Hubungan Industrial./ Merger is a process of merging two or more companies into one company, where the company takes it by combining shares in the form of assets and non-assets of the companies being merged. This merger is an effort by the company to survive, this is a strategic choice in the business / business activities of a limited liability company. When carrying out a company merger, there will be an impact on the employment relationship for workers/labourers and efforts to protect the law. The merger of companies will provide new synergies that have high competitiveness. The impact on the working relationship for the combined workers/laborers can be good, namely the workers/laborers continue to work and get increased welfare, and it can be no less good because the workers/laborers may be subject to termination of employment. This research is a legal research using statutory approach, conceptual approach, and case approach. Collection of materials through the method of literature study, with primary and secondary legal materials. Furthermore, legal materials are reviewed and analyzed with the approaches used in this study to answer the legal issues in this research. Termination of employment that occurs to workers as a result of company mergers can lead to industrial relations disputes, namely disputes over termination of employment. Disputes over termination of employment occur as a result of differences of opinion between workers and employers when termination of employment occurs. Legal remedies that can be taken by workers in the event of a dispute over termination of employment, namely by seeking a settlement outside the Industrial Relations Court starting from bipartite efforts, then the mediation or conciliation stages and settlement of disputes on termination of employment through a judicial institution, namely the Industrial Relations Court.
