Abstract

Dalam era globalisasi ini Teknologi Informasi dan komunikasi sangatlah berkembang pesat sehingga banyaknya manusia melakukan aktivitasnya melalui Media sosial. Dalam perkembanganya juga kejahatan tidak hanya ada di dunia nyata tetapi kerap juga terjadi dunia nyata akibat dari kurang bertanggungjawabnya manusia dalam menggunakan media sosial itu, seperti contohnya yang sering terjadi dalam dunia media sosial dengan korban utamanya yang sering menjadi incaran adalah pelecehan seksual verbal melalui media sosial. Adanya modus pelecehan seksual yang terjadi di media sosial seperi memberikan foto yang tidak senonoh, mengirimkan pesan yang melecehkan hingga ajakan dalam melakukan seks. Penelitian ini mengangkat permasalah bagaimana Tinjauan Yuridis Terhadap perlindungan hukum terhadap perempuan korban pelecehan seksual di media sosial? Penelitian ini menggunakan metode penelitian Yuridis Normatif dimana pendekatannya dilakukan melalui pendekatan perundang�undangan dan regulasi yang bersangkut paut dengan isu hukum yang sedang ditangani. Bedasarkan hasil penelitian ini, Indonesia memiliki Undang-Undang yang mengatur tindak pidana di media sosial yaitu: pertaman, Kitab Undang-Undang Hukum Pidana pasal 289 hingga 296. Kedua Kitab Undang-Undang 2016 tentang Informasi dan transaksi Elektronik yang terdapat pada pasal 27 ayat (1). Ketiga, Undang-Undang Nomor 44 tahun 2008 tentang pornografi psal 29 sampai dengan pasal 38./ In this era of globalization, information and communication technology is growing rapidly so that many people carry out their activities through social media. In its development, crime does not only exist in the real world but often occurs in the real world as a result of the irresponsibility of humans in using social media, for example, which often occurs in the world of social media, with the main victim often being targeted is verbal sexual harassment through social media. There are modes of sexual harassment that occur on social media, such as giving obscene photos, sending harassing messages to invitations to have sex. This study raises the issue of how is the juridical review of legal protection for women victims of sexual harassment on social media? This study uses a normative juridical research method where the approach is carried out through an approach to laws and regulations that are related to the legal issues being handled. Based on the results of this study, Indonesia has a law that regulates criminal acts on social media, namely: first, the Criminal Code Articles 289 to 296. Second, the 2016 Law on Information and Electronic transactions contained in article 27 paragraph ( 1). Third, Law Number 44 of 2008 concerning pornography articles 29 to 38.
