Ringkasan Isi : Putusan Mahkamah Konstitusi yang bersifat negative legislator merupakan putusan yang membatalkan materi muatan, ayat, pasal, dan/atau bagian undangundang yang bertentangan dengan UUD NRI 1945. Putusan tersebut dapat menimbulkan ketidakpastian hukum, sehingga sudah seharusnya DPR dan Presiden sebagai pemegang kekuasaan membentuk undang-undang menidak lanjutinya melalui revisi undang-undang. Namun, pada faktanya banyak putusan yang tidak ditindak lanjuti oleh DPR dan Presiden. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dimana penulis menganalisis penyebab DPR dan Presiden tidak menindak lanjuti putusan Mahkamah Konstitusi yang bersifat negative legislator dan bagaimana seharusnya DPR dan Presiden menindak lanjuti putusan tersebut. Putusan Mahkamah Konstitusi yang bersifat negative legislator tidak ditindak lanjuti oleh DPR dan Presiden disebabkan oleh beberapa faktor yaitu karena sifat putusan Mahkamah Konstitusi yang bersifat negative legislator adalah final dan mengikat, terbatasnya kewenangan Mahkamah Konstitusi, tidak ada ketentuan yang mewajibkan DPR dan Presiden untuk menindak lanjuti putusan tersebut, serta masalah proses pembentukan undang-undang dan masalah interpretasi norma hukum. Oleh karena itu sudah seharusnya DPR dan Presiden bertindak secara progresif untuk menjamin adanya kepastian hukum pasca adanya putusan Mahkamah Konstitusi yang bersifat negative legislator dengan menindak lanjuti putusan tersebut melalui revisi undang-undang./ A. Summary of Content : Decisions of the Constitutional Court that are negative legislators are decisions that invalidate the material content, paragraphs, articles, and / or parts of the law that are contrary to the 1945 Constitution of the Republic of Indonesia. These decisions can lead to legal uncertainty, so that the Parliament and the President as the holder of power should form a law legislation does not follow through revision of the law. However, in fact many decisions are not followed up by the Parliament and the President. The research method used is normative juridical research with a statutory approach where the authors analyze the causes of the DPR and the President not following up on the Constitutional Court's decision which is negative for the legislator and how the DPR and the President should follow up on the decision. Decisions of the Constitutional Court that are negative legislators are not followed up by the DPR and the President due to several factors, namely because the nature of the Constitutional Court decisions that are negative is the legislator is final and binding, the limited authority of the Constitutional Court, there are no provisions requiring the Parliament and the President to follow up on the decision as well as problems in the process of establishing laws and interpreting legal norms. Therefore, the House of Representatives and the President should have acted progressively to ensure legal certainty after the Constitutional Court's decision which was negative in nature by the legislator by following up on the decision through a revision of the law.
