Abstract

Virus corona adalah penyakit yang sangat menular, untuk mengatasi masalah kesehatan masyarakat dari segi kesehatan dan perekonomian, pemerintah melakukan upaya perlindungan dari segi hukum. Interaksi individu dan sosial dapat mempengaruhi kasus Covid-19. Rumusan masalah dalam disertasi ini adalah bagaimana sanksi terhadap pelanggaran ketentuan kesehatan dalam upaya pencegahan covid-19 di kota Jayapura, dan apa saja kendala dalam undang-undang terhadap pelanggaran ketentuan kesehatan pada masa covid-19 Kota Jayapura. Penelitian ini, yang bersifat hukum normatif, menggunakan pendekatan perundang-undangan. Data yang digunakan adalah data sekunder, terdiri dari bahan hukum primer seperti Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan; Undang-Undang Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan; Undang-Undang Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular; Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana; dan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Selain itu, contoh dokumen hukum sekunder mencakup buku-buku, hasil penelitian hukum, serta publikasi ilmiah dan jurnal yang terkait dengan hukum tentang penegakan protokol kesehatan selama pandemi COVID-19 di Kota Jayapura. Hasil skripsi yang ditemukan peneliti yang pertama, penerapan sanksi Aturan pelanggaran kondisi sanitasi selama Covid-19 di kota Jayapura belum berjalan dengan baik karena masyarakat tidak belajar untuk mengikuti tindakan sanitasi. Kedua, hambatan penegakan hukum terkait pelanggaran protokol kesehatan pada masa covid-19 di Kota Jayapura akibat dari ketidakpercayaan masyarakat terhadap penyakit menular covid-19, dan hambatan jika tidak mampu menegakkan hukum. The formulation of the problem in this dissertation is what the sanctions are for violations of health provisions in efforts to prevent Covid-19 in the city of Jayapura, and what are the obstacles in the law against violations of health provisions during the Covid-19 period in Jayapura City. This research is normative legal research with a statutory approach. The type of data used is secondary data consisting of primary legal materials, namely Law Number 36 of 2009 concerning Health, Law Number 6 of 2018 concerning Health Quarantine, Law Number 4 of 1984 concerning Infectious Disease Outbreaks, Law Number 24 of 2007 concerning Disaster Management, Law Number 23 of 2014 concerning Regional Government. Secondary legal materials such as books, legal research results, as well as scientific works and journals regarding regulations relating to law enforcement against violations of health protocols during the Covid-19 period in the city of Jayapura. The results of the thesis were found by the first researcher, the implementation of sanctions for violations of sanitary conditions during Covid-19 in the city of Jayapura has not gone well because people have not learned to follow sanitation measures. Second, obstacles to law enforcement related to violations of health protocols during the Covid-19 period in Jayapura City as a result of public distrust of the infectious disease Covid-19, and obstacles if they are unable to enforce the law.
