Abstract

Penelitian ini membahas kasus tindak pidana korupsi pengelolaan budidaya lobster dan ekspor benih bening lobster (BBL) yang menjerat Terdakwa II yaitu Siswadhi Pranoto Loe yang merupakan justice collaborator yang berhak memperoleh perlindungan hukum serta penghargaan dalam proses peradilan pidana. Sehingga tulisan ini akan membahas bagaimana pengaturan pemidanaan terhadap justice collaborator kasus tindak pidana korupsi dan bagaimana tinjauan yuridis pemidanaan terhadap terdakwa II Siswadhi Pranoto Loe selaku justice collaborator dalam kasus tindak pidana korupsi (Studi kasus putusan Nomor: 28/Pid.sus-TPK/2021/PN Jkt.pst). Metode penelitian yang digunakan dalam penulisan ini merupakan penelitian hukum normatif dengan pendekatan kualitatif. Data yang digunakan yaitu jenis data sekunder dengan bahan hukumnya berupa peraturan perundang-undangan, putusan pengadilan, teori hukum dan pendapat para sarjana hukum. Penelitian menyimpulkan bahwa pengaturan pemidanaan justice collaborator sebagaimana diatur dalam Undang-undang Nomor 31 Tahun 2014 Tentang Perlindungan Saksi dan Korban, Surat Edaran Mahkamah Agung No 4 Tahun 2011, dan peraturan perundang-undangan terkait lainnya yaitu seorang justice collaborator dapat dipertimbangkan oleh hakim untuk dijatuhkan pidana penjara paling ringan diantara terdakwa lainnya dalam kasus terkait. Namun dalam kasus ini, hakim tidak menjatuhkan pidana penjara paling ringan terhadap terdakwa II Siswadhi Pranoto Loe selaku justice collaborator sebagai bentuk penghargaan karena telah membantu penegak hukum mengungkapkan kasus korupsi ini. / This study discusses the criminal case of corruption in the management of lobster cultivation and the export of lobster clear seeds (BBL) that ensnared Defendant II, namely Siswadhi Pranoto Loe as a justice collaborator who is entitled to legal protection and awards in the criminal justice process. So this paper will discuss how to regulate the punishment of justice collaborators in corruption cases and how the juridical review of the conviction of defendant II Siswadhi Pranoto Loe as a justice collaborator in corruption cases (Case study of the verdict Number: 28/Pid.sus-TPK/2021/PN Jkt.pst). The research method used in this writing is normative legal research with a qualitative approach. The data used is a type of secondary data with legal materials in the form of laws and regulations, court decisions, legal theories and opinions of legal scholars. The study concluded that the sentencing arrangement of a justice collaborator as stipulated in Law Number 31 of 2014 concerning the Protection of Witnesses and Victims, Supreme Court Circular No. 4 of 2011, and other related laws and regulations, namely a justice collaborator can be considered by the judge to be sentenced to the lightest prison sentence among other defendants in related cases. However, in this case, the judge did not impose the lightest prison sentence on defendant II Sidwadhi Pranoto Loe as a justice collaborator as a form of appreciation for helping law enforcement uncover this corruption case.
