Abstract
Praktek hutang piutang biasanya dilandasi dengan Akta Pengakuan Hutang dan dikuatkan dengan adanya jaminan hak atas tanah yang kemudian diikuti dengan kuasa menjual. Permasalahan yang akan diteliti dalam penelitian ini adalah bagaimana akibat hukum terhadap perbuatan pengalihan kepemilikan atas jaminan dalam akta pengakuan hutang dengan akta kuasa menjual dan bagaimana pertimbangan Majelis Hakim terhadap Putusan Pengadilan Negeri Cibinong Nomor 28/Pdt.G/2018/Pn.Cbi. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dan teori yang diapakai adalah teori kepastian hukum dengan pendekatan kasus. Bahan hukum pimer dan sekunder : Undang Undang Nomor Tahun 1996, KUHPerdata, Putusan Pengadilan Negeri Cibinong Nomor 28/Pdt.G/2018/Pn.Cbi., buku-buku hukum. Akibat hukum terhadap pengalihan kepemilikan atas jaminan yang berdasarkan Akta Kuasa Menjual adalah batal demi hukum, menurut analisa perbuatan pengalihan kepemilikan atas jaminan bertentangan dengan pasal 6 Undang Undang Nomor 4 Tahun 1996. Seharusnya obyek jaminan dibuat Akta Pemberian Hak Tanggugan agar dapat dilelang atau di eksekusi. Dan Majelis Hakim dalam memutus perkara nomor 28/Pdt.G/2018/Pn.Cbi., memutuska bahwa gugatan tidak dapat diterima (Niet Onvankelijk Verklaaard). Dikarenakan penggugat mencampuradukkan dua dasar hukum yang berbeda, yaitu Perbuatan Melawan Hukum yang didasari dengan Wanprestasi. Seharusnya penggugat mengajukan gugatan wanprestasi terlebih dahulu sebelum perbuatan melawan hukum. / Debt practice which is usually based on the Deed of Recognition of Debt and strengthened by the existence of Debt Rights to land then followed by a guarantee of selling. The problems that will be discussed in this research are how the law against the transfer of ownership for collateral in the loan acknowledgment deed with the selling power deed and how the Judge judges the Cibinong District Court Decision Number 28 / Pdt.G / 2018 / Pn.Cbi. The method used in this study is a normative legal research method and the theory used is the theory of legal certainty with case discussions. Pimer and secondary legal materials: Law Number 1996, Civil Code, Decision of Cibinong District Court Number 28 / Pdt.G / 2018 / Pn.Cbi. Law books. Because the law regarding the transfer of ownership of the Selling Authority Deed is based on law, according to the analysis of the transfer action on the agreement with Law 6 of Act No. 4 of 1996. Guaranteed objects should be made to the Deed of Granting the Right to be auctioned or executed. And the Panel of Judges in deciding number 28 / Pdt.G / 2018 / Pn.Cbi., Deciding on a group is not acceptable (Niet Onvankelijk Verklaaard). Because the plaintiffs confuse two different legal grounds, namely Law Against Actions based on Default. The plaintiff should have requested a default lawsuit before acting against the law.
