Abstract

Dalam melakukan Paid Partnership di Instagram terdapat pula sebuah perjanjian yang telah diatur oleh salah satu pihak yaitu, pelaku usaha. Rumusan masalah dalam skripsi ini adalah perjanjian Paid Partnership termasuk dalam bentuk perjanjian yang mana, serta bagaimana mekanisme Paid Partnership di Instagram. Dan bilamana dalam pelaksanaan perjanjian tersebut terjadi sengketa, bagaimana penyelesaian sengketa tersebut. Penelitian ini merupakan penelitian kepustakaan. Dalam penelitian ini, penulis menggunakan data primer, sekunder, dan tersier. Data primer dalam penelitian ini adalah Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen , sedangkan data sekunder diperoleh dari buku�buku maupun literature, data tersier diperoleh menggunakan internet. Hasil penelitian menunjukan bahwa perjanjian Paid Partnership termasuk ke dalam perjanjian baku,karena di dalamnya terdapat klausula baku yang telah dirumuskan oleh pelaku usaha dan bila sudah ditandatangani pelaku usaha dan Selebgram yang bersangkutan akan memiliki kekuatan hukum yang sah dan bilamana terjadi sengketa dalam pelaksanaanya maka dapat mengambil jalur hukum yaitu secara litigasi maupun non-litigasi. / In conducting Paid Partnership on Instagram there is an agreement that has been set up by one of parties that involved that is business operators. Formulation of the problem is Paid Partnership on Instagram agreement enter into which type or form of agreement, as well as how the mechanism of Paid Partnership on Instagram. And when in the performance of the agreement there is a problem, how we can solve this. This research is a library research. In this study, the authors use primary, secondary, and tertiary data. Primary data in this study is concerning to Law No. 8 of 1999, while secondary data were obtained from books and literature, tertiary data were obtained using the internet. The results of the study showed that the agreements paid partnership is a part of the raw in agreement, because in the raw klausula which was formulated for business operators and when has been signed by business operators and selebgram will either legitimate having the force of law and when disputes happen in the implementation so can take route around a law litigation and non-litigation.
