Abstract
Rumah merupakan kebutuhan dasar manusia, namun belum semua anggota masyarakat dapat menikmati dan mendapatkan rumah yang layak, sehat, aman dan nyaman. Oleh karena itu upaya pembangunan perumahan dan pemukiman terus meningkat mengikuti kebutuhan konsumen.Dalam kegiatan usaha perumahan, pelaku usaha menggunakan berbagai cara mempromosikan produk mereka, untuk menarik perhatian para calon pembeli. Kegiatan promosi dilakukan melalui berbagai media promosi seperti brosur, iklan, dan janji yang disampaikan oleh pelaku usaha, akan tetapi dalam pelaksanaannya informasi yang didapat dari media promosi tidak nyata dan jelas, sehingga menimbulkan persepsi yang berbeda oleh konsumen. Dalam penelitian ini, metode yang digunakan adalah yuridis normatif, yaitu dengan mengkaji peraturan-peraturan hukum yang berlaku termasuk norma dan asas-asas yang terkandung dalam peraturan-peraturan yang berkaitan dengan hukum perlindungan konsumen dalam pembelian perumahan. Ketiadaan pengaturan tentang tata cara diajukannya keberatan menjadi hambatan bagi pengadilan negeri dalam melakukan upaya pemeriksaan keberatan oleh karena itu dengan dikeluarkannnya Peraturan Mahkamah Agung Tahun 2006 mengenai “Tata Cara Pengajuan Keberatan Terhadap Putusan BPSK”, maka diperoleh persamaan pandangan dalam menafsirkan suatu peraturan. Putusan mediasi dan konsiliasi dapat disepadankan dengan adanya suatu perdamaian (dading) di luar pengadilan atau di dalam pengadilan sehingga putusannya bersifat final dan mengikat. / Home is a basic human need, but not all community members can enjoy and get a decent, healthy, safe and comfortable. Therefore, housing development efforts and Residential areas continue to increase following consumer needs. In activities housing business, business actors use various promotional methods their products, to attract the attention of potential buyers. Promotional activities carried out through various promotional media such as brochures, advertisements and promises delivered by business actors, but in practice the information what is obtained from promotional media is not real and clear, giving rise to different perceptions by consumers. In this research, the method used is normative juridical, namely by reviewing the applicable legal regulations including norms and principles contained in the regulations relating to consumer protection laws in housing purchases. There is no regulation regarding the procedures for submitting objections obstacles for district courts in carrying out efforts to examine objections Therefore, with the issuance of the 2006 Supreme Court Regulation regarding "Procedures for Submitting Objections to BPSK Decisions", then obtain a common view in interpreting a regulation. Decision mediation and conciliation can be equated with the existence of peace (dading) outside the court or inside the court until the decision is made is final and binding.
