Abstract
Jaminan hak atas tanah merupakan hak yang melekat pada kreditor yang memberikan kewenangan untuk melakukan eksekusi kepada tanah yang dijadikan jaminan. Secara yuridis jaminan timbul karena adanya suatu perjanjian dengan pemilik agunan atau barang yang dijaminkan. Hak jaminan tidak dapat berdiri karena hak jaminan merupakan perjanjian yang bersifat tambahan (accessoir) dari perjanjian pokoknya, yakni perjanjian hutang piutang. Jaminan hak atas tanah yang dialihkan kreditur tanpa sepengetahuan debitur mengakibatkan akubat hukum. Rumusan masalah dalam skripsi ini adalah apa akibat hukum apabila jaminan hak atas tanah pada kreditur dialihkan tanpa sepengatahuan si debitur dan apakah putusan pengadilan Nomor 4/Pdt.G/2019/PN/Jth sudah sesuai dengan ketentuan hukum dibidang pertanahan. Penelitian ini menggunakan metode normatif yuridis, dengan metode pendekatan perundang-undang (statute approach) dan pendekatan kasus (case approach). Guna memperoleh hasil penelitian kasus, penulis menggunakan bahan hukum primer (Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan, Undang-Undang Nomor 5 Tanun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, dan Kitab Undang-Undang Hukum Perdata), untuk mendukung bahan hukum tersebut, juga dipergunakan bahan hukum sekunder berupa buku, internet. Adapun hasil penelitian ini adalah bahwa akibat hukum jaminan hak atas tanah yang dialihkan kreditur tanpa sepengetahuan debitur, mengakibatkan hak atas tanah secara hukum sah milik penggugat, pengalihan hak atas tanah oleh kreditur tanpa sepengetahuan debitur merupakan perbuatan melawan hukum dan pembatalan Akta Jual Beli mengandung cacat hukum. Kata Kunci : Jaminan Hak Atas Tanah Guaranteed land rights are rights inherent in the creditor who gives the authority to carry out executions to the land which is used as collateral. Legally the guarantee arises because of an agreement with the owner of the collateral or collateral. The guarantee right cannot stand because the guarantee right is an additional agreement (accessoir) from the main agreement, namely the loan agreement. The guarantee of land rights transferred by the creditor without the debtor's knowledge results in a legal outcome. The formulation of the problem in this thesis is what the legal consequences are if the guarantee of land rights to the creditor is transferred without the knowledge of the debtor and whether the court's decision Number 4 / Pdt.G / 2019 / PN / Jth is in accordance with the legal provisions in the land sector. This research uses the juridical normative method, with the statute approach and case approach. In order to obtain the results of case studies, the author uses primary legal materials (Law Number 4 of 1996 concerning Mortgage Rights, Law Number 5 of 1960 concerning Basic Agrarian Regulations, and the Civil Code), to support material the law, also used secondary legal materials in the form of books, internet. The results of this study are that due to the legal guarantee of land rights transferred by the creditor without the knowledge of the debtor, resulting in the legal rights of the plaintiff's property, the transfer of land rights by the creditor without the debtor's knowledge constitutes an act against the law and the cancellation of the Deed of Sale contains legal defects .
