Abstract
Penulisan ini bertujuan untuk mengetahui perlindungan hukum bagi tenaga kerja yang diputus hubungan kerjanya akibat menolak mutasi dan untuk mengetahui penerapan hukum dari pertimbangan hakim dalam Putusan Nomor 7/Pdt.Sus-PHI/2018/PN Gto. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, dengan sumber data yang digunakan berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Pendekatan penelitian yang digunakan ialah pendekatan kasus dari putusan Nomor 7/Pdt.Sus-PHI/2018/PN. Gto dan pendekatan perundang-undangan berupa Undang-Undang 1945, Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial dan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Dalam penelitian ini penulis menggunakan teknik pengumpulan data secara studi kepustakaan. Hasil penelitian menunjukan bahwa perlindungan hukum terhadap hak pekerja yang menolak mutasi ialah dengan memberikan pesangon karena menolak mutasi berarti menolak kewajiban dan dalam putusan majelis hakim pada putusan Nomor 7/Pdt.Sus-PHI/2018/PN.Gto dalam pertimbangannya Hakim telah menerapkan dan sesuai dengan Undang-Undang Nomor 13 Tahun 2003. Kata Kunci : Perlindungan Hukum, Pemutusan Hubungan Kerja, Mutasi This research aims to determine the legal protection for workers who are terminated due to refusing a mutation and to know the application of the law from the consideration of judges in Decision Number 7/Pdt.Sus-PHI/2018/PN Gto. The research conducted using juridisch normative research form, with data sources used in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The research approach used is a case approach from Decision Number 7/Pdt.Sus-PHI/2018/PN Gto and statue approach from the 1945 Constitution of the State of the Republic of Indonesia, the Civil Code, Act Number 2 Year 2004 concerning Industrial Relations Disputes Settlement and Act Number 13 Year 2003 concerning Manpower. In this research, collecting the material through the literature study methods. The results showed that the legal of the rights of workers who are terminated due to refusing a mutationby giving severance pay, because rejecting the mutation means rejecting the obligation and in the Decision Number 7/Pdt.Sus-PHI/2018/ PN Gto in its judgment already accordance with Act Number 13 Year 2003.
