Abstract

Skripsi ini membahas tentang bagaimana perlindungan hukum terhadap merek yang sama dan pelindungan terhadap kejahatan pemboncengan reputasi “passing off”.Dikarenakan pemboncengan reputasi merek sudah sering terjadi, sedangkan peraturan yang ada dalam UU Merek dan Indikasi Geografis dan Undang-Undang yang berkaitan dengan Merek tidak ada yang menuliskan dan mengatur mengenai pemboncengan reputasi (passing off) . Berkenan dengan hal tersebut terdapat kasus anatara dr. Fredi Setyawan pemilik nama dan logo “NATASHA” dengan Then Gek Tjoe pemilik nama dan logo “Natasha Skin Care” dimana disini pihak Then Gek Tjoe mendaftarkan merek dan logo “Natasha Skin Care” yang merupakan merek yang sudah terdaftar dan dimiliki oleh orang lain. Hasil penelitian ini diperoleh kesimpulan bahwa peraturan mengenai merek di Indonesia mengenai kejahatan pemboncengan reputasi (passing off) sebenarnya bisa dihentikan dengan memperhatikan Undang-Undang Nomor 20 tahun 2016 mengenai Merek dan Indikasi Geografis pasal 20 dan 21 walaupun tidak ada kata (passing off) tetapi pasal 20 dan 21 tersebut sudah cukup untuk melindungi merek terhadap kejahatan (passing off). Peneliti juga memperoleh perbedaan antara Undang-Undang Nomor 15 tahun 2001 tentang Merek dengan Undang-Undang Nomor 20 tahun 2016 tentang Merek dan Indikasi Geografis yang dimana Undang-Undang Nomo 15 tahun 2001 masih terdapat kekurangan dan belum dapat menampung perkembangan kebutuhan masyarakat di bidang Merek dan Indikasi Geografis serta belum cukup menjamin pelindungan potensi ekonomi lokal dan nasional. Adapun bentuk penelitian ini bersifat yuridis normatif yaitu meneliti secara kepustakaan dengan tipologi penelitian deskriptif analitis dan sumber data yang digunakan menggunakan data sekunder. Kata kunci : Merek, Passing Off, Perlindungan Merek This thesis discusses how the legal protection of the same brand and protection against the crime of driving a reputation of "passing off". Because of the brand's reputation, it has often happened, while the regulations in the Trademark Law and Geographical Indications and Laws relating to Trademarks do not exist. who writes and regulates about passing off. In this regard, there is a case between Dr. Fredi Setyawan owns the name and logo "NATASHA" with the Then Gek Tjoe owner and the name "Natasha Skin Care" wherein Then the party Gek Tjoe registered the brand and logo "Natasha Skin Care" which is a brand that has been registered and owned by other people. The results of this study conclude that regulations regarding brands in Indonesia regarding passing off crime can actually be stopped by observing Law No. 20 of 2016 concerning Trademarks and Geographical Indications of articles 20 and 21 even though there is no passing but article 20 and 21 are enough to protect the brand from passing (passing off). The researcher also obtained the difference between Law Number 15 of 2001 concerning Trademark and Law Number 20 of 2016 concerning Trademarks and Geographical Indications where the Law No. 15 of 2001 still lacked and could not accommodate the development of community needs in the field of Trademark and Geographical indications and not enough to guarantee the protection of local and national economic potential. The form of this research is normative juridical, which is to examine the literature with analytical descriptive research typology and data sources used using secondary data.
