Abstract

Konsekuensi dari kehidupan manusia sebagai makhluk sosial mengartikan bahwa dalam dirinya melekat hak dan kewajiban serta memerlukan suatu perlindungan dari negara. Keberadaan negara dari sisi peradaban manusia dapat dilihat sebagai sebuah evolusi maupun revolusi karena adanya kecenderungan manusia untuk bekerjasama dalam masyarakat dan kemudian membentuk suatu negara atas kesepakatan dalam pengertian sebagai suatu kontrak sosial. Kesepakatan lazimnya terbentuk atas persesuaian kehendak dari dua belah pihak karena adanya penawaran dan penerimaan (akseptasi), sehingga kesepakatan tersebut dijalankan oleh para pihak yang terlibat dalam hal ini ialah masyarakat yang membentuknya dengan mekanisme yang telah disesuaikan sebagai hukum. Kesepakatan disini membahas nilai-nilai kolektif dari masyarakat sebagai sebuah jiwa bangsa (volksgeist), yaitu dengan ideologi bangsa yang dalam hal ini adalah Pancasila sebagai ideologi dan sumber segala sumber hukum negara Indonesia. Kesepakatan yang sudah terbentuk kemudian melahirkan hukum karena diberikan otoritas yaitu daulat atau kuasa (sovereign) sebagai mekanisme penggerak atas unifikasi masyarakat dalam negara, sehingga dengan kata lain, kesepakatan sebagai kontrak sosial dalam konteks Pancasila. Berdasarkan uraian tersebut, maka dilakukan suatu penelitian dengan metode kualitatif yang substansinya menyelidiki paham filsafat hukum, peristiwa sejarah dan dinamika sosiologis masyarakat bangsa Indonesia. Pada akhirnya, penelitian ini berkesimpulan bahwa bentuk kesepakatan (kontrak sosial) telah diintervensi oleh relasi daulat atau kuasa. Kata Kunci: Kesepakatan, Hukum, Pancasila The consequences of human life as social beings mean that rights and obligations are inherent in themselves and require protection from the state. The existence of the state in terms of human civilization can be seen as an evolution or revolution because of the tendency of humans to cooperate in society and then to form a state by agreement in the mean as social contract. Agreements are usually formed based on the correspondence of the two parties due to the existence of an offer and acceptance, so that the agreement is carried out by the parties involved which in this term were the community that forms it with a mechanism that has been adjusted as law. The agreement here discusses about the collective values of society as a national soul (volksgeist), that is nation ideology which in this case is Pancasila as the ideology and the supreme source of state law of Indonesia. The agreement that was formed then gave birth to the law can be happened because it was given an authority by the sovereign or power as a movers mechanism on the unification of the people in the state, so it aim at the agreement as a social contract in the context of Pancasila. Based on the description, this research was conducted using qualitative methods whose the substance were investigates the understanding of law philosophy, historical phenomenon and the sociological dynamics of the Indonesian people. As a conclusion, this research aim that the form of an agreement (social contract) had been intervened by the relation of power (sovereign).
