Abstract
Manusia harus terus berinovasi dalam segala aspek kehidupan agar dapat terus berkembang. Selain itu, sebagai mahkluk sosial manusia juga memerlukan cara untuk bertahan hidup. Salah satunya yaitu dengan cara bekerja. Pekerjaan cukup erat keterkaitannya dengan kehidupan manusia karena dengan bekerja seseorang dapat memperoleh upah. Bagi manusia bekerja tidak hanya untuk memenuhi kebutuhan pokok, tetapi juga untuk meningkatkan status sosial. Rumusan masalah dalam skripsi ini adalah Bagaimana peraturan perundang undangan di Indonesia mengatur ketentuan pemutusan hubungan kerja akibat otomatisasi dan bagaimana perlindungan hukum terhadap pekerja/buruh atas pemutusan hubungan kerja akibat otomatisasi di era society 5.0. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan Undang Undang (Statue approach). Data yang digunakan adalah data sekunder berupa bahan hukum primer: Undang Undang RI No.13 Tahun 2003 Tentang Ketenagakerjaan, Peraturan Pemerintah Pengganti Undang Undang No.2 Tahun 2022 Tentang Cipta Kerja, Peraturan Pemerintah No.35 Tahun 2021 Tentang Perjanjian Kerja Waktu Tertentu, Alih daya, Waktu Kerja dan Waktu Istirahat, Dan Pemutusan Hubungan Kerja, sedangkan bahan hukum sekunder diperoleh dari buku-buku, maupun literatur lain. Dari hasil penelitian ini dapat disimpulkan bahwa dalam pelaksanaan pemutusan hubungan kerja akibat otomatisasi Indonesia harus diatur secara komprehensif agar kepastian hukum dan perlindungan hukum terhadap pekerja/buruh terlaksana dengan baik, diharapkan ke depan pemerintah membuat secara komprehensif peraturan perundang undangan tentang pemutusan hubungan kerja akibat otomatisasi. / Humans must continue to innovate in all aspects of life in order to continue to develop. In addition, as social beings, humans also need a way to survive. One of them is by working. Work is quite closely related to human life because by working a person can earn wages. For humans to work not only to meet basic needs, but also to improve social status. The formulation of the problem in this thesis is how the laws and regulations in Indonesia regulate the provisions for termination of employment due to automation and how is the legal protection for workers/laborers for termination of employment due to automation in the era of society 5.0. This research is a normative legal research with a Statue approach. The data used is secondary data in the form of primary legal materials: Republic of Indonesia Law No. 13 of 2003 concerning Manpower, Government Regulation in lieu of Law No. 2 of 2022 concerning Job Creation, Government Regulation No. 35 of 2021 concerning Certain Time Work Agreements, Transfers resources, working time and rest time, and termination of employment, while secondary legal materials are obtained from books and other literature. From the results of this study it can be concluded that in implementing termination of employment due to automation in Indonesia, it must be comprehensively regulated so that legal certainty and legal protection for workers/laborers are carried out properly. It is hoped that in the future the government will make comprehensive laws and regulations regarding termination of employment due to automation.
