Abstract
Bisnis kosmetik saat ini menjadi salah satu lahan yang menggiurkan bagi banyak pelaku usaha. Tingginya demand akan kosmetik membuat menjamurnya penjaja kosmetik dihampir semua platform e-coomerce. Hal ini dipengaruhi kondisi pandemi yang mengubah pola belanja masyarakat dari offline berubah ke online yang menyebabkan meningkatnya peredaran produk kosmetik ilegal di Indonesia dikarenakan prospek untungnya besar. Selain meningkatnya industri kosmetik, para pelaku usaha juga berbondong-bondong menggunakan jasa endorsement influencer, dikarenakan konsumen lebih percaya dengan review yang diberikan oleh influencer. Saat ini pelaku usaha menjual produk kosmetik tanpa memperdulikan apakah produk tersebut memiliki izin edar atau tidak, serta tidak memperdulikan kualitas apakah sudah sesuai persyaratan keamanan, kualiatas dan mutu sama halnya dengan influencer. Penulis akan menjabarkan tentang analisa penulis mengenai Putusan Nomor 1555/Pid.Sus/2019/PN.Sby dan pertanggungjawaban hukum pelaku usaha dan influencer atas beredarnya produk kosmetik ilegal. Metode penelitian yang digunakan yaitu metode yuridis normatif. Pendekatan yang digunakan adalah pendekatan kasus dan pendekatan perundang-undangan. Metode pengumpulan data yang dipergunakan adalah studi kepustakaan dan putusan hakim. Perlindungan hukum konsumen dan pertanggungjawaban hukum dari pelaku usaha atas beredarnya kosmetik ilegal sudah diatur dalam UUPK, tetapi untuk perlindungan konsumen atas kosmetik ilegal dan informasi palsu yang diberikan oleh xvi Universitas Kristen Indonesia influencer belum jelas pengaturannya di perundang-undangan manapun baik itu UUPK ataupun UUITE sehingga dibutuhkan perhatian lebih oleh pemerintah. Kata Kunci : Pelaku Usaha, Influencer, Endorsemet, Konsumen, Promosi, Kosmetik, Perlindungan Konsumen. / The cosmetics business is currently one of the lucrative fields for many business actors. The high demand for cosmetics has led to the proliferation of cosmetic vendors on almost all e-commerce platforms. This is influenced by pandemic conditions that change people's shopping patterns from offline to online, which has led to an increase in the circulation of illegal cosmetic products in Indonesia due to the great profit prospects. In addition to the increase in the cosmetics industry, business actors are also flocking to use influencer endorsement services, because consumers are more confident in the reviews provided by influencers. Currently, business actors sell cosmetic products without caring whether the product has a distribution permit or not, and do not care whether the quality is in accordance with safety, quality and quality requirements as well as influencers. The author will describe the author's analysis of Decision Number 1555/Pid.Sus/2019/PN.Sby and the legal liability of business actors and influencers for the circulation of illegal cosmetic products. The research method used is the normative juridical method. The approaches used are case approach and statutory approach. The data collection method used is literature study and judge's decision. The legal protection of consumers and the legal liability of business actors for the circulation of illegal cosmetics are regulated in the UUPK, but for consumer protection of illegal cosmetics and false information provided by influencers, the arrangements are not clear in any legislation, be it the UUPK or UUITE, so more attention is needed by the government.
