Abstract

Tenaga Listrik merupakan komoditi yang sangat penting bagi masyarakat. Penyediaan dan pemanfaatan tenaga listrik harus dikelola atau dalam pengawasan pemerintah, juga dengan memperhatikan keamanan instalasi, keselamatan manusia, dan lingkungan hidup di sekitar instalasi. Disamping bermanfaat bermanfaat bagi masyarakat tenaga listrik menjadi sesuatu hal yang bisa mengakibatkan bahaya keselamatan. Pemerintah sebagai regulator mengatur tentang keselamatan ketenegalistrikan ini yang dituangkan dalam Undang-Undang Republik Indonesia Nomor 30 Tahun 2009 tentang Ketenagalistrikan. Peraturan yang berkaitan dengan Keselamatan Ketenagalistrikan juga diatur dengan penerbitan Peraturan Menteri ESDM No. 12 Tahun 2019 tentang Kapasitas Pembangkit Tenaga Listrik Untuk Kepentingan Sendiri berdasarkan Izin Operasi. Metode penelitian yang dilakukan adalah metode penelitian hukum normatif dengan menganalisa perundang-undangan yang berlaku didukung penelitian kuantitatif. Dengan berlakunya ketentuan batas total kapasitas pembangkit tenaga listrik yang di atas 500 kVA dalam 1 (satu) sistem instalasi tenaga listrik berdasarkan Permen ESDM 12 Tahun 2019, maka izin operasional diatas 200 kVA — 500 kVA tidak menjadi kewajiban bagi usaha penyediaan tenaga listrik untuk kepentingan sendiri. Izin operasional dalam batasan 200 kVA-500 kVA dapat diterbitkan Pernerintah Daerah Provinsi.Pembangkit tenaga listrik untuk keperluan sendiri dengan jumlah kapasitas lebih dari 500 (lima ratus) kVA yang dihubungkan dalam 1 (satu) sistim Instalasi Tenaga Listrik diwajibkan mempunyai SLO. Aturan pelaksanaan dalam pembatasan kapasitas ijin operasi kelistrikan untuk kepentingan sendiri harus tetap memperhatikan keLaikan operasi yang ditentikan dengan sertifikat Laik operasi pembangkit. Disarankan agar aturan pelaksanaan Peraturan Menteri ESDM atas pembatasan kapasitas kan keLaikan operasi pembangkit listrik harus selaras dengan UU No.30 pasal 44 s/d 46 harus memiliki sertifikat Laik Operasi dan Peraturan Menteri ESDM nomor 12 tahun 2019 harus dirubah dengan menambahkan kausul kewajiban semua pembangkit listrik tanpa membatasi kapasitas pembangkit untuk kepentingan sendiri harus memiliki sertifikat Laik Operasi./ Electricity is a very important commodity for society. The supply and use of electric power must be managed or under government supervision, also taking into account installation security, human safety, and the environment around the installation. Besides being useful for the community, electric power is something that can cause a safety hazard. The government as the regulator regulates electricity safety as outlined in the Law of the Republic of Indonesia Number 30 of 2009 concerning Electricity. Regulations related to Electricity Safety are also regulated by the issuance of Minister of Energy and Mineral Resources Regulation No. 12 of 2019 concerning Power Generation Capacity for Own Interest based on an Operating Permit. The research method used is the normative legal research method by analyzing the applicable laws supported by quantitative research. With the enactment of the regulation on the total power generation capacity limit of more than 500 kVA in 1 (one) power installation system based on Minister of Energy and Mineral Resources 12 of 2019, operational permits above 200 kVA - 500 kVA are not mandatory for businesses providing electricity for their own interests. . Operational permits within the range of 200 kVA-500 kVA can be issued by the Provincial Government. Power plants for their own needs with a total capacity of more than 500 (five hundred) kVA connected in 1 (one) Electric Power Installation system are required to have SLO. The implementation rules in limiting the capacity of electricity operating permits for their own interests must still pay attention to the feasibility of operation as determined by the generator operation worthiness certificate. It is recommended that the implementation rules of the Minister of Energy and Mineral Resources regarding capacity restrictions and the feasibility of operating power plants must be in line with Law No. 30 articles 44 to 46 must have a certificate of Operational Worthiness and Regulation of the Minister of Energy and Mineral Resources number 12 of 2019 must be amended by adding a clause on the obligations of all power plants without limiting the generating capacity for its own interests must have a certificate of Operation Worthiness.
