Abstract

Transmisi virus COVID-19 turut menghambat berbagai aspek kehidupan di berbagai negara, tak terkecuali di bidang ekonomi. Dalam pelaksanaan pembangunan nasional, tenaga kerja memiliki peranan serta kedudukan penting sebagai pelaku dan tujuan pembangunan. PHK dianggap sebagai upaya terakhir untuk mengatasi permasalahan ekonomi yang dialami oleh banyak pelaku usaha di Indonesia. Rumusan masalah dalam penulisan ini adalah apakah Pandemi Covid-19 sebagai keadaan memaksa (Force Majeure) dapat dijadikan alasan Pemutusan Hubungan Kerja, Dan apa saja hak pekerja dalam Pemutusan Hubungan Kerja dampak dari Pandemi Covid-19. Metode penelitian skripsi ini menggunakan metode yuridis normatif yang didukung oleh studi kepustakaan dengan perundang-undangan sebagai bahan hukum primer, bahan hukum sekunder seperti literatur-literatur dan bahan hukum tersier (non hukum). Dari hasil penelitian ini, dapat disimpulkan bahwa Force Majeure memiliki konsekuensi hukum, yaitu batal atau tertundanya kewajiban atau pelaksanaan prestasi dalam suatu kontrak hingga ganti rugi. Hasil penelitian rumusan masalah kedua adalah pemutusan Hubungan Kerja di masa Pandemi Covid-19 terjadi karena penurunan pendapatan perusahaan yang berakibat ketidaksangupan perusahaan dalam memenuhi kebutuhannya, termasuk dalam hal pembayaran upah pekerja Kata Kunci: Covid-19, Force Majeure, Pekerja, Pemutusan Hubungan Kerja./ The transmission of the COVID-19 virus has also hampered various aspects of life in various countries, including in the economic sector. In the implementation of national development, the workforce has an important role and position as actors and development goals. Layoffs are considered a last resort to overcome the economic problems experienced by many business actors in Indonesia. The formulation of the problem in this writing is whether the Covid-19 Pandemic as a force majeure can be used as a reason for termination of employment, and what are the rights of workers in termination of employment as a result of the Covid-19 Pandemic. The research method of this thesis uses a juridical normative method which is supported by a literature study with legislation as primary legal material, secondary legal materials such as literature and tertiary legal materials (non-legal). From the results of this study, it can be concluded that Force Majeure has legal consequences, namely the cancellation or delay of obligations or the implementation of achievements in a contract to compensation. The results of the second problem formulation study were termination of employment during the Covid-19 Pandemic occurred due to a decrease in company income which resulted in the company's unability to meet its needs, including in terms of paying worker's wages.
