Abstract

Transaksi E-Commerce merupakan pembaharuan atau modernisasi dari transaksi konvensional yang tidak mempertemukan pelaku usaha dan konsumen karena semuanya dilakukan secara online melalui web atau media platform. Maka posisi konsumen yang tidak bertemu langsung dengan pelaku usaha harus mendapatkan perlindungan hukum. Oleh karena itu untuk mengetahui dan membahas lebih lanjut mengenai perlindungan hukum tersebut terdapat rumusan masalah dalam penulisan hukum ini yaitu bagaimana perlindungan hukum terhadap korban dalam transaksi jual beli online atau E-Commerce dan bagaimana penerapan hukum dalam putusan pengadilan nomor 311/Pid.Sus/2017/PN.Yyk. Penulisan hukum ini menggunakan metode penelitian yuridis normatif, jenis data yang digunakan adalah data sekunder, metode pendekatan yang digunakan adalah pendekatan undang-undang (statue approach), dan analisis data menggunakan analisis kualitatif untuk mengetahui perlindungan hukum terhadap korban dalam transaksi jual beli online atau E-Commerce. Kata Kunci : Perlindungan Konsumen, Jual Beli Online atau E-Commerce, Penerapan Hukum./ E-Commerce transactions are an update or modernization of conventional transactions that do not bring together business actors and consumers because everything is done online through the web or platform media. So the position of consumers who do not meet directly with business actors must get legal protection. Therefore, to find out and discuss more about the legal protection, there is a formulation of the problem in writing this law, namely how to legally protect victims in online buying and selling transactions or ECommerce and how the law is applied in court decision number 311 / Pid.Sus / 2017 / PN. Yyk.This legal writing uses normative juridical research methods, the type of data used is secondary data, the approach method used is a legal approach (statue approach), and data analysis uses qualitative analysis to determine legal protection for victims in online buying and selling transactions or E-Commerce.
