Abstract

Hukum dalam masyarakat sebagai bentuk penyelenggaraan Negara yang baik menghendaki hukum tidak lagi menjadi alat untuk kepentingan penguasa, tapi turut menentukan bagaimana hukum seharusnya dijalankan yang menjadi sorotan adalah Prinsip prinsip Good Governance dan Good Corporate Governance pada Penegakan Hukum dalam Perbankan. Bagaimana Perlindungan hukum Kreditur terjamin. yang bertujuan merealisasikan terbentuknya sebuah masyarakat yang nyaman dan berkeadilan. Karena tidak jarang hukum itu dicederai, oleh oknum yang mempunyai kepentingan, atau oknum yang menganggap tidak pentingnya hukum yang ada di masyarakat. Prinsip-prinsip Good Governance dan Good Corporate Governance merupakan suatu karakterisitik yang berkaitan dengan control dan pengendalian, yang harus dipenuhi dalam pelaksanaan roda Industri Perbankan. Berkaitan dengan control dan pengendalian suatu pemerintahan yang baik seharusnya mencapai hasil yang baik. Pemerintah adalah manajer professional yang disewa oleh rakyat untuk menyelenggarakan organisasi negara untuk sebesar-besarnya kemanfaatan rakyat. Prinsip Good Governance yang sudah terstruktur dengan baik sesuai hukum yang berlaku yang mengikat untuk dilaksanakan namun masih ada kasus Bank Century dan kejahatan Perbankkan lainnya, Methode penelitian menggunakan penelitian hukum normatif. penelitian hukum kepustakaan mengacu hukum posistif. banyak mencari literature dari buku-buku terkait Lembaga Penjaminan Simpanan (LPS) dan juga perannya dalam penjaminan Nasabah Kreditur. Saat ini Pengawasan oleh BI sebagian pelaksanaanya dilakukan Otoritas Jasa Keuangan (OJK) secara berkordinasi dan saling menginformasikan bila indikasi suatu bank yang sedang bermasalah kepada Bank Indonesia bersinergi dalam pengawasannya. Sesuai dengan wewenang.
