Abstract

Nama : Mrius Air NIM : 1802190031 Judul : Kajian Hukum Terhadap Implementasi Peraturan Daerah Khusus Provinsi Papua Barat (Studi Kasus Uu No 21 Tahun 2001 Tentang Otonomi Khusus Di Provinsi Papua Barat) Jumlah Halaman : 94 Halaman Kata Kunci : Otonomi Khusus,Perdasus, Hirarki Peraturan Perundang-Undangan, Implemntasi, Provinsi Papua Barat Abstrak Penelitian ini bertujuan untuk mengkaji implementasi Peraturan Daerah Khusus Provinsi Papua Barat dalam rangka pelaksanaan otonomi khusus Provinsi Papua Barat, Karena keberhasilan undang-undang No 21 Tahun 2001 Tentang Otonomi Khusus ini terletak pada bagaimana pelaksanaan Perdasus. Penelitian ini adalah studi kasus dari implementasi UU No 21 Tahun 2001 Tentang Otonomi Khusus Provinsi Papua Jo UU No 35 Tahun 2008. Penelitian ini menggunakan teori peraturan perundang-undangan dari Hans Kelsen bersama muritnya Hans Nawiasky tentang Stufenbau Theory. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dengan tiga teknik yaitu, pengumpulan dokumen,wawancara mendalam dan observasi. Hasil penelitian menunjelaskan bahwa masih banyak Perdasus di Provinsi Papua Barat belum terbentuk, dan hal ini akan mempengaruhi terhadap kualitas dan evektifitas cita-cita hukum Otsus di Provinsi Papua Barat, khususnya implementasi Otsus di Papua Barat. Penelitian ini merekomendasikan agar pemerintah Provinsi Papua Barat meningkatkan kualitas dan kuantitas dalam penyusunan Perdasus, pemerintah di dalam refisi UU Otsus agar tidak memperhatikan keuangan semata tetapi perhatianya lebih pada pemberdayaan,perlindungan dan keberpihakan pada OAP, Pemerintah Pusat dan Daerah melakukan penguatan kapasitas kelembagaan melalui pembentukan komisi hukum ad hoc yang nantinya bertugas untuk memantau dan mengawasi pelaksanaan Otsus di tanah Papua lebih Khusus di Provinsi Papua Barat./ Name : Mrius Air NIM : 1802190031 title : Legal Studies on the Implementation of Special Regional Regulations for West Papua Province (Case Study of Law No. 21 of 2001 concerning Special Autonomy in West Papua Province) Number of pages : 94 Pages Keywords : Special Autonomy, Perdasus, Hierarchy of Legislation, Implementation, West Papua Province Abstract This study aims to examine the implementation of the West Papua Province Special Regional Regulation in the context of implementing the West Papua Province special autonomy, because the implementation of Law No. 21 of 2001 concerning Special Autonomy lies in how the Perdasus is implemented. This research is a case study of the implementation of Law No. 21 of 2001 concerning Special Autonomy for Papua Province in conjunction with Law No. 35 of 2008. This research uses the theory of legislation from Hans Kelsen and his student Hans Nawiasky on Stufenbau Theory. The research method used in this research is qualitative with three techniques, namely, document collection, in-depth interviews and observation. The results of the study explain that there are still many Perdasus in West Papua Province that have not been formed, and this will affect the quality and effectiveness of the legal ideals of Otsus in West Papua Province, especially the implementation of Otsus in West Papua. This study recommends that the West Papua Provincial government improve the quality and quantity in the preparation of the Perdasus, the government in the revision of the Special Autonomy Law so that it does not pay attention to finances but focuses more on empowerment, protection and alignment with OAP, the Central and Regional Governments increase capacity through the formation of ad hoc laws. hoc which will later be stored and supervised the implementation of Otsus in Papua, more specifically in West Papua Province.
