Abstract

Pegawai Pemerintah dengan Perjanjian Kerja berdasarkan Undang-Undang No 5 Tahun 2014 tentang Aparatur Sipil Negara adalah Warga Negara Indonesia yang memenuhi syarat tertentu, yang diangkat berdasarkan Perjanjian Kerja untuk jangka waktu tertentu dalam rangka melaksanakan tugas Pemerintahan. Penerapaan PPPK seharusnya dilaksanakan mulai pemberlakukan Peraturan pemerintah No 49 tahun 2018 tentang Manajemen Pegawai Pemerintah sebagai peraturan Pelaksana, namun dalam penerapanya Dinas Koperasi dan Usaha Kecil Menengah Kota Tagerang Selatan belum menerapkan PPPK, hal ini sungguh sangat merugikan bagi pekerja non PNS (Honorer) karna salah satu tujuan pemberlakuan sistem PPPK ini ialah memberikan kepastian dan perlindungan hukum kepada tenaga kerja Pemerintah non PNS agar memperoleh Hak dan Perlindungan Hukum yang lebih baik dari status sebelumnya (Honorer). Secara Peinsip Pengaturan tentang PPPK belum menjelaskan secara detail Hak dan Perlindungan Hukum bagi PPPK contohnya, dalam penyelesaian sengketa PPPK memiliki proses yang sangat rumit dimana PPPK harus melalui 2 (dua) kali banding administratif baru sengketa dapat diselesaikan di Pengadilan Tata Usaha Negara (PTUN), secara komparatif jika dibandingkan dengan peraturan Ketenagakerjaan yang berlaku saat ini, khususnya dalam bagian Hak dan Perlindungan Hukum sangat jauh berbeda, dimana dalam Undang-undang Ketenagakerjaan mengatur jelas Hak dan Perlindungan Hukum jika terjadi pelaggaran, sebagai contoh karyawan swasta memiliki alur penyelesaian sengketa yang pasti dan tidak panjang dan rumit, serta Perlindungan Hukum yang tertulis jelas dalam Undang-undang Ketenagakerjaan yang berlaku, Berdasarkan hal ini seharusya Dinas Koperasi Kota Tangerang Selatan mulai bisa menerapkan pengaturan PPPK sebagai langkah awal memberikan Perlindungan Hukum yang sedikit lebih baik dari sebelumnya sesuai dengan tujuan diberlakukannya manajemen PPPK, selain itu juga lembaga Legislatif dalam hal ini Dewan Perwakilan Rakyat (DPR) isa merevisi Undang-Undang 5 tahun 2014 tentang Aparatur Sipil Negara serta peratura Turunannya untuk dapat memberikan Hak dan Perlindungan yang pasti, adil dan bermanfaat bagi PPPK./ Government Employees with Work Agreements based on Law No. 5 of 2014 concerning State Civil Apparatus are Indonesian citizens who meet certain requirements, who are appointed based on the Work Agreement for a certain period of time in order to carry out government duties. The implementation of PPPK should be implemented starting with the implementation of Government Regulation No. 49 of 2018 concerning Management of Government Employees as an Implementing Regulation, but in its implementation the Cooperatives and Small and Medium Enterprises Office of South Tagerang City has not implemented PPPK, this is really very detrimental for non-PNS (Honorer) workers because it is wrong One purpose of implementing this PPPK system is to provide legal certainty and protection to non- civil servant government workers in order to obtain better legal rights and protection than their previous status (honorary). In principle, the regulation on PPPK has not explained in detail the Rights and Legal Protection for PPPK, for example, in resolving disputes, PPPK has a very complicated process where PPPK must go through 2 (two) administrative appeals before the dispute can be resolved at the State Administrative Court (PTUN), Comparatively when compared to the current Manpower regulations, especially in the section on Legal Rights and Protection, it is very much different, where the Manpower Law clearly regulates Legal Rights and Protection in the event of a violation, for example private employees have a definite dispute resolution flow and not long and complicated, as well as Legal Protection which is clearly written in the applicable Manpower Act, Based on this, the South Tangerang City Cooperative Service should start to implement the PPPK arrangement as a first step to provide legal protection that is slightly better than before in accordance with the purpose of implementing the PPPK management, besides that the Legislative institution in this case the House of Representatives (DPR) can revise the Law. - Law 5 of 2014 concerning State Civil Apparatus and its derivative regulations to be able to provide certain, fair and beneficial Rights and Protections for PPPK.
