RINGKASAN ISI : Kebutuhan untuk membeli apartemen saat ini semakin meningkat seiring dengan jumlah penduduk dan ketersediaan lahan yang semakin terbatas. Situasi ini dimanfaatkan oleh pengembang untuk membangun dan memasarkan apartemen. Proses pembangunan serta pemasaran apartemen tidak selalu berjalan mulus seperti yang diharapkan, dalam kasus yang terjadi pihak pengembang dianggap merugikan konsumen sebagai pembeli unit apartemen karena belum menyelesaikan pembangunan apartemen meskipun unit apartemen telah dibayar sepenuhnya. Oleh karena itu konsumen memutuskan untuk mengajukan pailit terhadap pengembang. Akibat pailitnya pengembang, seluruh aset yang dimiliki oleh pengembang termasuk gedung apartemen beralih menjadi harta pailit. Hal tersebut juga menyebabkan Perjanjian Pendahuluan Jual Beli (P4TB) milik konsumen menjadi hapus, serta status hukum konsumen pun berubah. Oleh karena itu, penulis mengajukan suatu permasalahan tentang bagaimana perlindungan hukum bagi konsumen selaku pembeli satuan unit apartemen terhadap pengembang apartemen telah dinyatakan pailit? Metode penelitian yang penulis gunakan adalah metode Penelitian Hukum Normatif dan didukung oleh beberapa pengumpulan data perpustakaan. Setelah dilakukan penelitian, undang-undang telah memberikan perlindungan preventif bagi konsumen, berdasarkan Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen, pengembang wajib memberikan kompensasi atas kerugian yang diderita konsumen. Namun untuk perlindungan represif yang didasarkan pada Undang-Undang No. 37 Tahun 2004 tentang Kepailitan Dan Penundaan Kewajiban Penyelesaian Utang, disebutkan bahwa jika di dalam suatu perjanjian ada komitmen untuk menyerahkan suatu barang dagangan dalam jangka waktu tertentu dan orang tersebut dinyatakan pailit maka perjanjian tersebut menjadi hapus, setelah dikeluarkannya putusan pailit, pihak lain dapat mengajukan permohonan agar diperlakukan sebagai Kreditur konkuren untuk mendapatkan ganti rugi. UU Perlindungan Konsumen dan UU Kepailitan dalam kasus seperti ini belum memberikan perlindungan yang maksimal kepada konsumen. SUMMARY : The needs for buy an apartment currently increasing as the population and availability of land becomes limited. This situation is utilized by the developer to build and market apartment. However, the process to build and market an apartment isn’t always run smoothly as expected, in this case the developer is deemed to do harm the consumers as an Apartment Unit’s purchasers because they haven’t completed the apartment construction eventhough the apartment units have been paid in full. Therefore consumers are decided to propose for bankruptcy against the developer. As a result of the bankruptcy of the developer, all assets that owned by the developer including the apartment building turn become a bankruptcy assets. It also causes the Conditional Sale and Purchase Agreement (P4TB) owned by consumers are terminated as well as the legal status of consumers are changed. Therefore, the author propose an issue about how the law protect the consumers as an Apartment Unit’s Purchasers in terms the developers has been declared bankrupt? The research method that author uses for the issue is Normative Law Research methods and supported by some library data collection techniques. After conducted the research, the law has been provided a preventive protection for consumer, based on Consumer Protection Act No. 8/1999, developer as an entrepreneurs are obligated to give compensation for the losses suffered by consumers. But for the repressive protection, which is based on Bankruptcy And Postponement Of Debt Settlement Obligation Act No.37/2004, said that If there is a commitment to deliver a merchandise within certain period and the person declared as bankrupt, the agreement shall become terminated upon the issuance of bankruptcy declaration decision, the other party may file a request that it be treated as unsecured Creditor to obtain compensation. Consumer Protection Act and Bankruptcy And Postponement Of Debt Settlement Obligation Act yet has not provided maximum protection to consumer.
