Abstract

Pencabulan sering kali disebut sebagai perilaku menyimpang karena perbuatan tersebut memaksa seseorang agar terlibat dalam suatu hubungan seksual atau menjadikan seseorang tersebut sebagai objek untuk memuaskan hawa nafsunya. Pada pencabulan biasanya dilakukan oleh laki-laki terhadap perempuan, atau bisa juga terjadi pada anak di bawah umur sering kali perilaku tersebut dianggap tidak pantas dan senonoh tapi tidak dianggap demikian oleh laki-laki, misalnya sentuhan atau bahan lelucon yang mengarah seksual dan seseorang yang menjadi objek sentuhan atau bahan lelucon tersebut menjadi trauma. Penelitian ini membahas mengenai Analisis Yuridis Tindak Pidana Terhadap Pelaku Pelecehan di Sosial Media (Putusan Nomor : 342/Pid.Sus/2020/PN.Jkt.Tim). Tujuan Penelitian ini untuk mengetahui latar belakang penyebab terjadinya tindak pidana pencabulan, penegakan hukum terhadap pelaku tindak pidana pencabulan. Penulis menggunakan metode penelitian normatif yang dimana penelitian ini mengacu kepada undang- undang pornografi. Jenis data dalam penelitian ini adalah data sekunder yang diperoleh dari studi kepustakaan./ Sexual abuse it is often referred to as deviant behavior because the act forces a person to engage in a sexual relationship or makes the person an object to satisfy their desires. Sexual abuse is usually carried out by men against women, or it can also occur in minors, often this behavior is considered inappropriate and obscene but is not considered so by men, for example touching or jokes that are sexually suggestive and someone who become the object of touch or the subject of the joke becomes traumatized. This study discusses the Juridical Analysis of Criminal Acts of Sexual Abuse on Social Media (Decision Number: 342/Pid.Sus/2020/PN.Jkt.Tim). The purpose of this study was to determine the background of the causes of the occurrence of criminal acts of sexual abuse, law enforcement against perpetrators of criminal acts of sexual abuse. The author uses a normative research method where this research refers to the pornography law. The type of data in this study is secondary data obtained from literature study.
