Abstract

Latar belakang masalah penelitian ini adalah, bahwa terjadinya tindak pidana narkotika sudah sering didengar di Negara Republik Indonesia dimana kejahatan terhadap narkotika ini sudah menyebabkan banyak generasi kecanduan narkotika dan juga dapat dikatakan bahwa Negara Republik Indonesia darurat narkotika berdasarkan Persebaran Kawasan Rawan Narkotika data Badan Narkotika Nasional pada saat Rapat Pembahasan Revisi Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika. Sehingga dalam penelitian ini mengambil rumusan masalah yaitu mengapa Pegawai BNN RI dapat melakukan penyalahgunaan narkotika dan bagaimana proses penegakan hukum terhadap pegawai BNN RI yang melakukan penyalahgunaan narkotika. Metode Penelitian ini menggunakan pendekatan empiris. Penelitian ini dilakukan lewat studi kepustakaan dimana sumber data yang dikumpulkan ialah data primer yang dilakukan melalui wawancara terhadap Bapak Toton Rasyid, S.H., M.H selaku Kasubdit Bantuan Hukum Direktorat Hukum BNN RI. Lokasi penelitian ini dilakukan di Badan Narkotika Nasional Cawang Jakarta, dengan tujuan untuk mengetahui Efektivitas Berlakunya Undang-Undang Narkotika di dalam Lingkungan Badan Narkotika Nasional Republik Indonesia. Hasil dari penelitian ini menunjukan bahwa pegawai BNN RI dapat melakukan penyalahgunaan narkotika dengan beberapa faktor internal maupun eskternal. Penegakan Hukum terhadap pegawai BNN RI sudah sesuai dengan Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika akan tetapi, kasus penyalahgunaan narkotika yang dilakukan oleh pegawai BNN RI seharusnya di publikasikan sehingga masyarakat tidak memandang sebelah mata mengenai instansi BNN RI dan menjadi informasi sekaligus edukasi terhadap masyarakat umum. / The background of the problem of this research is that the occurrence of narcotics crimes has often been heard in the Republic of Indonesia where crimes against narcotics have caused many generations to become addicted to narcotics and it can also be said that the Republic of Indonesia is a narcotics emergency based on the Distribution of Narcotics Prone Areas data from the National Narcotics Agency in during the Discussion Meeting on the Revision of Law Number 35 of 2009 concerning Narcotics. So that in this study the formulation of the problem is why BNN RI employees can abuse narcotics and how is the law enforcement process against BNN RI employees who abuse narcotics. Methods This research uses an empirical approach. This research was conducted through a literature study where the source of the data collected was primary data which was conducted through interviews with Mr. Toton Rasyid, SH, MH as the Head of Sub- Directorate of Legal Aid of the Legal Directorate of the National Narcotics Agency of the Republic of Indonesia. The location of this research was carried out at the Cawang National Narcotics Agency, Jakarta, with the aim of knowing the Effectiveness of the Enforcement of the Narcotics Law within the National Narcotics Agency of the Republic of Indonesia. The results of this study indicate that BNN RI employees can abuse narcotics with several internal and external factors. Law enforcement against BNN RI employees is in accordance with Law Number 35 of 2009 concerning Narcotics, however, narcotics abuse cases committed by BNN RI employees should be published so that the public does not look down on the BNN RI agency and becomes information as well as education for the public. general.
