Dr. Fernando Silalahi, SH., MH Halaman : 103 Halaman + x Daftar Acuan : 37 + 4 Undang-undang Pesatnya perkembangan teknologi informasi dan komunikasi di berbagai belahan dunia telah menciptakan peluang-peluang baru bagi kejahatan baru yang terkadang justru tidak dapat dilakukan di dunia nyata. Salah satu kejahatan tersebut adalah mengenai penyebaran berita bohong/hoax. Berdasarkan uraian tersebut di atas, yang melatar belakangi permasalahan bagaimana pengaturan sanksi pidana yang diatur dalam Peraturan Pidana dan Undang-undang ITE terhadap penyebaran berita bohong dan bagaimana penerapan sanski terhadap kasus berita bohong/ hoax yang dilakukan Ratna Sarumpaet. Jenis dan penelitian yang digunakan dalam penelitian ini adalah yuridis normatif ialah penelitian yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Kemudian hasil dari data yang dianalisi berbentuk deskritif analisis, yaitu berupa pemaparan secara mendalam mengenai implikasi hukum terhadap penyebaran berita bohong/hoax berdasarkan Peraturan Pidana dan Undnag-undang Informasi Teknologi Elektronik (ITE). Hasil penelitian menunjukkan bahwa penulis tidak setuju terhadap tuntutan dan putusan yang dijatuhkan hakim, karena masih adanya beberapa unsur yang tidak terpenuhi dan pasal yang dijatuhkan terhadap terdakwa Ratna Sarumpaet tidak memberikan kejelasan mengenai saran/media yang digunakan saat melakukan penyebaran berita bohong/hoax. One such crime is about spreading hoax news. Based on the description above, the background of the problem is how to regulate criminal sanctions regulated in the Criminal Regulations and the ITE Law on spreading false news and how to apply sanski to hoax / hoax cases by Ratna Sarumpaet. The type and research used in this study is normative juridical is research conducted by examining library materials or secondary data. Then the results of the analyzed data are in the form of descriptive analysis, namely in the form of in-depth exposure of the legal implications of spreading hoax news based on Criminal Regulations and Electronic Information Technology Law (ITE). The results showed that the author did not agree with the demands and decisions handed down by the judge, because there were still some elements that were not fulfilled and the article handed down to the defendant Ratna Sarumpaet did not provide clarity about the advice / media used when spreading hoax news.
